Instock gas supply requires immediate delivery (0-2 days). Back order gas supply has a short-term delivery delay (2 days to 2 weeks). Custom order gas supply has a long-term delivery (2 weeks to 2 months). The contractor must deliver requested instock gases within 96 hours (48 hours for emergency requests) after notification. Routine deliveries shall be made no later than **** hours on the third business day following placement of the order. Emergency orders shall be delivered within 24 hours.

The contractor shall replace any industrial or specialty gas that fails to meet the required specifications for purity, laboratory standards, or content at no cost to the government within 48 hours of receiving a discrepancy notification. The contractor shall replace any externally faulty or inoperable cylinders within 96 hours of being notified by the COR at no cost to the government.

The award will be made on the basis of the lowest evaluated price of proposals meeting or exceeding the acceptability standards for the specification requirements (Lowest Price Technically Acceptable - LPTA).

Determination of contractors responsibility will be determined in accordance with FAR ****, System of Award Management registration. Contracts will be awarded only to prospective contractors that the contracting officer determines to be responsible. Offerors must meet the general standards of responsibility set forth in FAR ****.

Failure to address each requirement will result in the price proposal being rated unacceptable. No award can be made to an offeror who has been determined non-responsible by the contracting officer.

The estimated contract ceiling value is $2,058,****.

The period of performance is from September 1, 2026, to August 31, 2027.

The US Navy anticipates using Wide Area Workflow (WAWF) to pay invoices in accordance with DFARS ****.

All items must be covered by the manufacturer's warranty.

Award will be made to the responsible offeror whose offer conforms to the solicitation requirements and is determined to be the best value offeror after performing a best value tradeoff analysis, where price is more important than nonprice factors.

Contractor must complete all representations and certifications found in the provisions listed within their profile in the System for Award Management (SAM) at www. ***. *. * to be considered for this solicitation.

Taking exception to any provision in the solicitation without addressing the exception with the contracting office before the offer due date specified within the solicitation will render the offer ineligible for award.

Proposals are due by Wednesday, August 19, 2026, by 2 PM EST. Proposals received after 2:00 pm are late and will not be accepted.

The contract will be awarded to the responsible proposer that submits a responsive proposal determined to be the most advantageous to the city, based on evaluation factors including overall proposal quality, respondents qualifications, proposed methodology, and total cost. if two offers are found to be substantially technically equivalent, price shall be the basis for determining the award recipient.

The selected consultant must possess a minimum of ten years of experience in municipal zoning, land use, or sign code drafting and be able to complete the work within 6 months of entering into contract. The city reserves the right to apply the case law under general municipal law 103 regarding bidder responsibility in determining whether a proposer is a responsible vendor for the purpose of this rfp process.

Proposers may be disqualified for failure to submit any required attachment, exhibit, or for submitting incomplete or nonresponsive information. Delinquent proposerscontractors shall not be deemed responsible for purposes of awarding a contract.
