The contractor warrants that materials and equipment furnished under this contract will be of good quality and new unless otherwise required or permitted by the contract.

The board of education reserves the right to award the contracts to the lowest responsible and responsive bidders meeting all of the specifications.

The successful contractor must be a firm regularly engaged in recycling and trash removal, and must have been engaged in work similar to that required at least five years.

If the successful bidder fails, after seven 7 days written notice, to supply enough properly skilled workmen, or proper materials, or fails to prosecute the work to assure completion pursuant to contract terms, the district may terminate the contract without further notice to the contractor.

The school district reserves the right to request a representative sample of the item quoted upon either prior to the award or before shipments are made.

Important contractors currently on the new york state department of labor debarred list will not be considered for any award of this contract.

The period of performance is from October 1, 2026 through December 29, 2026.

Invoices shall be submitted in arrears: monthly in arrears.

The government reserves the right to inspect and investigate the facilities, business reputation, and other qualifications of any quoter as necessary to determine capability to perform the requirement.

Bids shall be submitted and received in the division of purchasing up to and including 2:00 pm. , Wednesday, September 9, 2026.

All invoices will be net30 days.

Award shall be made to the responsible bidder proposing the lowest per ton price, whose proposal complies with all provisions to render it formal and legal.

In the event of a default and cancellation of the contract, the bidder shall be responsible for payment to broome county of a sum equal to the additional contract costs to the county.

Every request for interpretation should be addressed to the designated contact persons listed in the specifications no later than five working days prior to the date set for bid opening.

Failure to follow the forklift training standard shall be a material breach of your contract with broome county.

Payment will be made in accordance with the terms of the contract or the sellers invoice, whichever are more favorable to broome county.
