Respondents must affirm that the information and supporting documentation submitted with the subcontracting plan is true and correct. The respondent must seek approval from the contracting agency prior to making any modifications to its subcontracting plan. espondent understands and agrees that, if awarded any portion of the contract: the respondent must seek approval from the contracting agency prior to making any modifications to its subcontracting plan, including hiring subcontractors to perform any work under this contract.

Onsite reviews of the company's headquarters and/or work site where services are being performed may be required. he respondent must, upon request, allow the contracting agency to perform onsite reviews of the companys headquar ters andor work site where services are being performed and must provide documentation regarding staffing and other resources.

The response due date is July 7, 2026, at 1:30 PM Central Time in Austin, TX. The preferred number of delivery days after receipt of order is no more than 30.

Payment terms for the State of Texas are typically 30 days. Respondents may provide additional discounts.

The warranty period begins on the date of customer acceptance and lasts for six months, the manufacturer's standard warranty, or the shelf life, whichever is longer. Contractor warrants against defects in workmanship and material for a period of i six 6 months or ii the duration of the manufacturers standard warranty or iii the duration of the shelf life as referenced in attachment f, whichever is longer.

CPA will determine best value for the state, considering compliance with specifications, purchase price, risk of vendor nonperformance, and delivery time after receipt of purchase order.

CPA may disqualify a respondent if there is an unacceptable risk that it will fail to perform the contract. The respondent bears the burden of establishing ability, capacity, skill, promptness, character, responsibility, integrity, current compliance with laws, sufficient financial resources, and conformity to specifications.

The customer may perform sample testing on shipments or lots. The sample must conform to the item specification in this solicitation.

Communicating with anyone other than the point of contact listed may result in disqualification. Failure to submit required documentation, such as the mandatory price sheet or execution of response, may lead to disqualification.

Offers must be submitted no later than June 4, 2026, 2:00 p. m. CT. Late offers will not be considered.

Payments will be made in accordance with the Texas Prompt Payment Act, generally within 30 days of receiving an undisputed invoice. CPA may process payments on a quarterly basis.

The successful respondent warrants that its performance will be conducted conscientiously in a professional and workmanlike manner, complying with the highest professional standards.

Offers will be evaluated under the best value standard, with criteria including respondents past performance, qualifications, experience (20%), compliance with CPA specifications (50%), and cost (30%).

Vendors must be qualified to provide Oracle PeopleSoft licensed software and software support services.

In the event of a default or breach, CPA may require the successful respondent to pay liquidated damages of 2% of the total cost for services or obligations not completed per calendar day of delay.

There is no pre-offer inspection or site visit mentioned for this solicitation.

Failure to observe restrictions on contact with CPA staff, submitting late offers, or failing to meet RFO requirements may result in disqualification.

Successful respondent represents and warrants that its performance under the contract shall be conducted conscientiously in a professional and workmanlike manner to the full extent of successful respondents talents and capabilities with due diligence and in full compliance with the highest professional standards of practice in the industry applicable to the services.

Offers will be evaluated under the best value standard, with criteria including respondents past performance, qualifications, experience (20%), compliance with CPA specifications (50%), and cost (30%).

Vendors must be qualified and respondents must provide a profile describing the size and scope of operations, general nature of previous similar work, prior contracting experience with CPA and other public sector entities, and financial stability.

In the event of a default or breach of contract, CPA may require the successful respondent to pay, as liquidated damages and not as a penalty, an amount equivalent to two percent of the total cost for services or obligations not completed as required by the contract per calendar day of delay.

Failure of a respondent or any of its representatives to observe the restriction on contacting CPA staff (other than the designated contact person) may result in disqualification of any related offer.

If nonpayment of the Texas Smartbuy administrative fee reaches 90 days, the contractor may be placed on warrant hold. CPA and the customer may exercise contractual remedies in connection with late delivery.

CPA may request samples prior to award for evaluation purposes. If requested, respondent must submit samples within sixty calendar days of receipt of the request. Failure to submit samples is cause for disqualification.

Communicating with anyone other than the point of contact listed may result in disqualification. CPA will disqualify any response received without the required documentation. Failure to submit signed addenda, certified lab test reports, or samples (if requested) may cause disqualification.
