The bid must be fully and properly executed by an authorized person. Delivery of bid proposals must be made by the time and to the place stipulated in the advertisement. It is the sole responsibility of the bidder to see that his bid proposal is received in the proper time. Any bid proposals received after the scheduled closing time for receipt of bid proposals shall be returned to the bidderproposer unopened. Delivery of products shall be made within thirty calendar days after receipt of a purchase order by the contractor, unless otherwise specified in the bid documents/bid specifications.
Invoices for payments will not be processed without a valid purchase order and confirmation of receipt by a town employee. Payments shall be made to the contractor in arrears and shall be expressly contingent upon the contractor submitting a claim form in a form provided by the town, stating with reasonable specificity the product or services provided and the payment requested, certifying that the sum sought is just, true and correct, and is accompanied by documentation satisfactory to the town supporting the amount claimed. Claims shall be submitted no more frequently than once a month and no later than three months following the towns receipt of the product or services performed.
Contractor warrants and represents that products delivered pursuant to this contract conform to the manufacturers specifications, performance standards and documentation, and the documentation fully describes the proper procedure for using the products. Contractor warrants and represents that components or deliverables specified and furnished by or through contractor shall individually, and where specified and furnished as a system, be substantially uninterrupted or errorfree in operation and guaranteed against faulty material and workmanship for the warranty period, or for a minimum of one year from the date of acceptance, whichever is longer project warranty period. During the project warranty period, defects in the materials or workmanship of components or deliverables specified and furnished by or through contractor shall be repaired or replaced by contractor at no cost or expense to the town.
The contract shall be awarded as soon thereafter as practicable. The town reserves the absolute right to reject any and all bids, and to waive any informalities therein. The town board reserves the right to reject any and all bidsproposals and to waive any informalities in the bidsproposals received, and to accept the bidproposal most favorable to the interests of the town, after all bidsproposals have been analyzed, checked and verified. The award is the decision of the town to accept the bidproposal of the lowest responsive, responsible biddercontractor for the procurement included in these bid documents.
The town will not accept bids from, nor award a contract to, anyone who cannot prove to the satisfaction of the town that the bidder has sufficient experience and/or is financially able and organized to successfully comply with the requirements set forth herein. A bidders qualifications statement is required. The town retains the right to investigate, verify the information submitted in the disclosure statement, and interview all bidders prior to award of the contract.
Failure to fully comply with any of the requirements or instructions contained within the bid document may constitute sufficient cause for rejection of the bidproposal. Such rejections will be subject to the discretion of the director of purchasing. Failure to meet such delivery time schedule may be grounds for cancellation of the order or, in the directors discretion, the contract. The town further reserves the absolute right to authorize the immediate purchase of the product from other sources, purchase from other sources without recourse to and by the contractor for the costs and expenses thereof to replace all or part of the products which are the subject of the delay, may be deducted from the contract quantities without penalty or liability to the town.
Where a site inspection is required by the bid specifications or project definition, bidder shall be required to inspect the site, including environmental or other conditions for preexisting deficiencies that may affect the installed product, equipment, or environment or services to be provided and, which may affect bidders ability to properly deliver, install or otherwise provide the required product. All inquiries regarding such conditions shall be made in writing.
Bid specifications may indicate that the product to be purchased must be equal to a standard sample on display in a place designated by the director and such sample will be made available to the bidder for examination prior to the opening date. The director reserves the right to request from the biddercontractor a representative samples of the product offered at any time prior to or after award of a contract. Samples must be submitted free of charge and be accompanied by the bidders name and address, any descriptive literature relating to the product and a statement indicating how and where the sample is to be returned.
A bid proposal submitted by a bidder who is not in full compliance with the provisions of the town of north hempstead, town code at the time of submission will be denied. The town will not accept bids from, nor award a contract to, anyone who cannot prove to the satisfaction of the town that the bidder has sufficient experience and/or is financially able and organized to successfully comply with the requirements set forth herein.
