The pricing model requires a fixed price for each milestone. Complete the schedule of milestones and payments, ota attachment 03 to indicate a fixedprice for each milestone.

Proposals will be evaluated based on relevant past performance, technical feasibility and maturity of solution, schedule for phase I and II, operations and maintenance concept, and price reasonableness and realism. The total value of the resulting Phase I agreement is anticipated not to exceed $60M. for planning purposes, the government anticipates the total value of the resulting phase i agreement to not exceed 60m

The contractor shall accomplish final completion of all of the work no later than 300 days following the notice to proceed.

The owner shall make progress payments to the contractor on account of the contract price. After fifty percent 50 of the work has been completed, the contractor may increase his payment request percentage to be one hundred percent 100 of work completed for the remaining half of the project instead of the ninetyfive percent 95 set forth above.

The contractor warrants to the owner that all labor furnished to progress the work under this contract will be competent to perform the tasks undertaken, that the product of such labor will yield only firstclass results, that materials and equipment furnished will be of good quality and new unless otherwise permitted by this contract, and that the work will be of good quality, free from faults and defects and in strict conformance with this contract.

All bids will be awarded to the lowest responsive and responsible bidder. This determination may involve all or some of the following factors: price, conformity to specifications, financial ability to meet the contract, previous performance, facilities and equipment, availability of repair parts, experience, delivery promise, terms of payments, compatibility as required, other costs, and other objective and accountable factors which are reasonable.

Bids of $100,000 or more will be accepted only from qualified general contractors licensed by the state licensing board of general contractors of Alabama as required by code of Alabama **** titles 34 and 46 as amended. Only bids of such contractors who are licensed prior to the date of the bid opening will be considered.

In the event that unexcused delay causes the contractor to fail to accomplish substantial completion of the work in accordance with the dates set forth herein, for each and every day of delay the contractor shall pay to the owner the sum identified below per day for liquidated damages for the loss of use.

A prebid conference will be held at the project location Fire Station No. 1 located at **** Clinton Avenue, Huntsville, Alabama **** at 10:00 am local time on the above referenced date at which time city representatives will discuss the project and answer questions. This prebid conference is not mandatory, but prospective bidders are encouraged to attend.

Bidders may be disqualified, and rejection of bids may be recommended for any of but not limited to the following causes: Failure to use the bid forms furnished by the city, lack of signature by an authorized representative on the bid form, failure to properly complete the bid form and vendor compliance, evidence of collusion among bidders, unauthorized alteration of the bid form, failure to submit a bid bond.
