Respondents are required to review the attachment prior to submitting proposals. Exceptions to the attachment must be submitted with proposals. Certain articles, sections, and exhibits are non-negotiable. The service contract will be fully negotiated between the Texas Facilities Commission (TFC) and the successful respondent prior to award. Upon notice of award, the awardee must submit final, negotiated versions of exhibit A (TFC facilities list) and exhibit B (compensation and fees). The contract covers
HVAC maintenance, installation, and
repair services at various state-owned facilities throughout Texas. Quotes must include a breakdown of materials and labor, hourly rates, estimated hours, project completion timeframe, overtime/regular hours, markups over cost, labor type/description, and third-party subcontractor/supplier quotes (if applicable). Quotes do not include taxes. TFC contract administrator may negotiate more advantageous pricing. No minimum amount of work or purchase orders are guaranteed. Response times for non-emergency and emergency requests are specified. Working hours are from 7:00 AM to 5:00 PM, Monday through Friday, excluding national holidays. Emergency response is 24/7. Work outside regular hours requires pre-authorization. All fixtures must match existing fixtures.
HVAC equipment and materials must be of equal or better quality. Parts and operating manuals must be provided within five business days of project completion. Training on new equipment may be requested. During projects requiring subcontracting, supervisor oversight is required. All technicians must be registered with the Texas Department of Licensing and Regulation (TDLR). Travel time is not reimbursable. Service tickets must be checked in/out with the TFC contract administrator. Freight and shipping charges are not allowable. Expedited shipping may be allowed with prior approval. Technicians must be properly trained, certified, and licensed. TFC reserves the right to verify certifications. Contractor is responsible for training, certification, and license renewals. Contractor must ensure compliance with building codes and NFPA requirements. Work must be completed within the agreed timeframe. As-built drawings must be furnished within five business days of completion. Modifications to specifications or drawings require written approval. Contractor must have a local physical office with local telephone service. Contractor must provide an emergency 24-hour response number. Contractor must examine all facilities and be familiar with conditions. Contractor is responsible for all damage to existing facilities. Contractor must notify the TFC contract administrator of any damage. Contractor must
repair or restore all damage. Contractor may utilize utilities from existing outlets. Contractor must keep premises clean. Contractor must remove and dispose of all debris. Contractor must abide by all security procedures. Contractor personnel must wear identification badges. Access routes, parking, and storage areas are designated by the TFC contract administrator. Smoking is prohibited in all facilities. Salvageable materials may be offered to contractor. Safety Data Sheets (SDS) for all chemicals must be provided. Callback service is required at no additional cost. Contract effective date is the date of last signature and expires on August 31, 2027. Contract may be renewed for two additional two-year periods. TFC may request a three-month extension for resolicitation. Termination provisions are included, including default and non-default scenarios. Unsatisfactory performance criteria and corrective action plans are detailed. No liability upon termination. If federal or state requirements change, performance will be subject to the applicable requirements at the time of performance. TFC retains ownership of work products upon termination or expiration.
