If applicable, the company acknowledges that delayed performance will damage the city, but by their nature, such damages are difficult to ascertain. Accordingly, the liquidated damages provisions stated in the contract documents will apply. Liquidated damages are not intended to be a penalty and are solely intended to compensate for damages. If proper authority is given to proceed with the purchase, the purchased items are required to be delivered by or before the date on which is designated on the purchase order or contract determined by winning bidder and city with a **** fifty 00/100 US dollars per day in liquidated damages for exceeding the schedule will apply.
