The Commonwealth of Pennsylvania is issuing an Invitation for Bids (IFB) to meet the needs of the PA Game Commission for a 23HTE Grad Patch bid. Bids must be submitted electronically through the commonwealth's electronic system (SRM). The bid protest procedure is available on the DGS website. The contract term will commence on the original PO effective date and end upon complete delivery and acceptance of the awarded items, the expiration of any specified warranty and maintenance period, payment by the commonwealth for the items received, or any expiration date identified in the purchase order. The contract may be mutually renewed for a maximum of 4 additional 1 year terms. The commonwealth reserves the right to make changes at any time during the term of the contract. The contractor must comply with all applicable federal and state laws and regulations and local ordinances in the performance of the contract. The contractor shall indemnify the commonwealth against all third-party claims. The commonwealth shall have the right, at reasonable times and at a site designated by the commonwealth, to audit the books, documents and records of the contractor to the extent that the books, documents and records relate to costs or pricing data for the contract.
The contract states that all items must be delivered within the time period specified, and time is of the essence. Unless otherwise stated in this contract, delivery must be made within thirty 30 days after the effective date.
The commonwealth shall put forth reasonable efforts to make payment by the required payment date. The required payment date is: a the date on which payment is due under the terms of the contract b thirty 30 days after a proper invoice actually is received at the bill to address if a date on which payment is due is not specified in the contract a proper invoice is not received until the commonwealth accepts the service as satisfactorily performed or c the payment date specified on the invoice if later than the dates established by a and b above.
The contractor warrants that all items furnished and all services performed by the contractor, its agents and subcontractors shall be free and clear of any defects in workmanship or materials. Unless otherwise stated in the contract, all items are warranted for a period of one year following delivery by the contractor and acceptance by the commonwealth.

If the lowest responsible bidder withdraws its bid prior to the expiration of the award period or fails to comply with the requirements set forth in the ifb, the bidder shall be liable to the commonwealth for all costs and damages associated with the reaward or rebid. If the lowest responsible bidder, as determined by the issuing office, withdraws its bid prior to the expiration of the award period or fails to comply with the requirements set forth in the ifb including but not limited to any requirement to submit performance or payment bonds or insurance certificates within the required time period, the bidder shall be liable to the commonwealth for all costs and damages associated with the reaward or rebid including the difference between the bidders price and the actual cost that the commonwealth pays for the awarded items.
In the event of a controversy or claim arising from the contract, the contractor must, within six months after the cause of action accrues, file a written claim with the contracting officer for a determination.
