The contractor warrants and implies that the items delivered under this contract are merchantable and fit for use for the particular purpose described in this contract.

An acceptable letter of commitment is required from all distributor offerors to be eligible for award.

Failure or refusal to reach agreement with the ppvs and maintain an agreement with the ppvs throughout the entire contract period shall constitute sufficient cause for terminating the contract under far ****, contract terms and conditions.
