The contractor shall guarantee that all plants are true to botanical name and that the quality and size meet specifications, as are required herein. The contractor shall fully guarantee that all plants are in a vigorous growing condition during and at the end of the guarantee period. The guarantee period shall expire one 1 year from the date of acceptance by the owner.

Violation of the Living Wage Ordinance is punishable by fines of not more than $500 per violation plus costs, with each day being considered a separate violation. Additionally, the City of Ann Arbor has the right to modify, terminate, cancel or suspend a contract in the event of a violation of the ordinance.

If any individual believes there has been a violation of this chapter, heshe may file a complaint with the Citys Human Rights Commission. The complaint must be filed within 180 calendar days from the date of the individuals knowledge of the allegedly discriminatory action or 180 calendar days from the date when the individual should have known of the allegedly discriminatory action.

Disclosing a potential conflict of interest does not disqualify vendors. In the event vendors do not disclose potential conflicts of interest and they are detected by the City, vendor will be exempt from doing business with the City.

The anticipated date of delivery of the corrugated culvert shall be included on the bid. If the delivery date stated in the bid is not met, the county may assess liquidated damages against the contractor in the amount of **** for each calendar day beyond the stated delivery date on the bid form.

Payment to contractor will be made upon delivery of the box culvert to Montrose County Road and Bridge Yard and approval of invoice. Payment will follow normal county payment processing cycles for issuance of checks.

Specific warranties included in bid price are to be detailed in the bid form.

Award may be made to the lowest responsive, responsible bidder meeting applicable county and state procurement requirements. The county reserves the right to accept the bid that provides the best value to the county in the county's sole discretion.

The county reserves the right to make a determination in the county's sole discretion as to the sufficiency of qualifications of any bidder.

If the delivery date stated in the bid is not met, the county may assess liquidated damages against the contractor in the amount of **** for each calendar day beyond the stated delivery date on the bid form.

The county reserves the right to reject, for any reason whatsoever, any and all bids, and to waive any informality or irregularity in a bid.

For any exception to the delivery date as specified on this order, vendor shall give prior notification and obtain written approval thereto from the purchasing agent or appropriate buyer. Time is of the essence and the order is subject to termination for failure to deliver as specified.

The county shall evaluate bids in response to this solicitation and will award a contract based on lowest and best criteria in accordance with Oklahoma statute title 19, section **** based on lowest and best criteria which includes, but not limited to, the operational cost the county, quality andor technical competency, delivery and or implementation schedule, maximum facilitation, data exchange andor integration, warranties, guarantees, return policy, vendor stability, best solution to proposed planning documents andor strategic program, vendor experience, vendor prior performance, vendor expertise with similar scope, extent and quality of proposed participation and acceptance of all usergroups, proven methodology and tools, innovative use of current technologies and quality results by vendor.
