Payment will be made in 30-day increments based on periodic estimates, provided all payrolls and material bills are paid. The contractor guarantees all work for one year from the date of written acceptance, covering defects in materials, labor, and workmanship. The project shall be awarded to the lowest responsive and responsible bidder who meets the city's minimum qualifications and demonstrates experience in high-pressure natural gas pipeline construction and valve replacement. Failure to secure permits within five days of the notice to proceed may result in award to the next lowest bidder, and the original contractor may be billed for the price difference. Final delivery of material will be on or before 365 days after the effective date of the resulting contract.

A one-year warranty from the date of delivery is required for supplies of a noncomplex nature.

Past performance will be considered in the evaluation of offers.

A facility clearance may be required in accordance with FAR **** in the event of an award, as the requirement requires access to classified drawings.

Specific delivery lead times will be established at the BPA call level. Delivery is FOB destination, New Port, RI ****.

If UID applies, payment will be via Wide Area Workflow (WAWF). If UID does not apply and there are no surcharges, the government's preferred payment method is via credit card.

Offers will be evaluated in accordance with attachment 3, Section M: Evaluation Factors for Award. In order to be considered for award, an offeror must receive a pass/fail rating of pass and must have an acceptable rating in every non-cost factor.

Offerors must be registered in the System for Award Management (SAM) and **** to drawings/technical data package requires an active registration in JCP, current CMMC certification at the required level or higher, and a NIST SP **** DoD assessment not more than 3 years old.

The government reserves the right to remove a contractor from this BPA for reasons including, but not limited to: failure to submit a responsive, technically viable proposal on three consecutive task order solicitations for which the contractor is qualified, documented marginal or unsatisfactory performance, or failure to maintain its small business status.
