Asphalt Quality Government Bids & RFPs

The delivery date shall be considered by the director of purchase in making the award. Such delivery date shall be of the essence of the contract. If the contractor and/or supplier fails to complete the contract within the specified delivery date or within any extensions thereof granted in accordance with this section, the city may elect to permit the contractor and/or supplier to proceed with and complete the contract, provided, however, that in any such case such permission shall not be deemed a waiver in any respect by the city of the contractor's and/or supplier's liability for damages or expenses thereby incurred by the city as a result of the failure to complete delivery within the specified time, but such liability shall continue in full force against the contractor and/or supplier as if such permission had not been granted.

Payment for material, supplies or equipment called for herein shall be made within thirty (30) days after approved completion of contract and the rendition of proper invoice to the division of accounting, 65 Niagara Square, Room **** City Hall, Buffalo, New York ****.

The director of purchase reserves the right to award this contract, after considering bid proposals, in the best interest of the City of Buffalo.

Ordinarily, proposals are not considered from bidders on supplies, material or equipment, if the bidder or manufacturer of same is in bankruptcy, or in the hands of a receiver at the time of tendering a proposal or at the time of entering into a contract, but the director of purchase reserves the right to accept or reject such proposals in the best interest of the city. No bid shall be accepted from any person or corporation that is in arrears to the city upon any debt or contract.

In order to avoid all controversy in the determination of actual damages or expenses to the city for the delay in completion of the contract by reason of the city's election not to terminate the right of the contractor and/or supplier to proceed with the completion of the contract, the contractor and/or supplier and their surety shall be liable for and shall pay or allow to the city a sum equal to one percent (1%) of the total amount of the contract per day as fixed and agreed liquidated damages for each and every calendar day, Sundays and holidays included, after the date fixed for delivery during which time the contract shall remain incomplete, and any such damages and expenses may be deducted by the city from any payment or payments then due or thereafter to fall due to the contractor and/or supplier.

The division of engineering may request a sample of product from the successful bidder, prior to finalizing the award.

Any contact with the governmental entity, other than to discuss current business with the City of Buffalo, or during the question and answer period via email only with the persons identified below, may result in a offeror's immediate disqualification.

The period of performance for this project is expected to be 90 days from the issuance of the contract award.

The resulting contract will be a firm fixed price award. The bid notice mentions that no payments above 80% of the total contract value will be paid until the work final inspection is complete and accepted.

After final acceptance of the entire project, the contractor shall provide a one-year written warranty letter along with any other warranties for the project. The warranty response requires the contractor to physically respond on site within 2 business days after being notified of a warranty issue.

Award will be made to the lowest priced, technically acceptable (LPTA) offeror that meets the requirements stated in the statement of work and the solicitation.

Contractors must demonstrate a minimum of five (5) years of relevant experience in similar projects, expertise in concrete and asphalt removal, and possess certifications relevant to parking lot construction. Familiarity with Department of Defense construction standards and Unified Facilities Criteria (UFC) is essential. All personnel must be OSHA certified and trained in federal environmental compliance. Contractors must be capable of obtaining base access clearance and adhering to DSCR security protocols.

Liquidated damages will be assessed for non-compensable delays wherein the work is not accepted prior to the scheduled completion date, in the amount of $500 for each calendar day of delay.

A site visit is scheduled for June 2, 2026, at 10:00 AM. You need to coordinate site access with Robert Miller at least one full week before needing installation access. The meeting point is DSCR Building 205.

Questions are due on June 5, 2026, end of day.

Failure to provide all required documents at the time of submission will result in the contractor's proposal being technically unacceptable. Contractors who do not meet the minimum experience requirement may be deemed nonresponsive and disqualified.

The estimated magnitude of construction for this requirement is between $250,000 and $500,000.

The bid tabulation report shows the responsive bids received for the solicitation, with Missouri River Contractors LLC being awarded the contract.

The engineers estimate for the project is $1,122,****.

The bid opening date is June 16, 2026, at 2:00 PM CST. Deliveries shall occur between 7:00 AM and 5:00 PM, Monday through Friday, excluding city holidays, unless specific arrangements are made.

Payment will be made for goods delivered and accepted by the City within 30 days of completion, subject to receipt of an acceptable invoice.

The contractor warrants that all products supplied under this agreement are new, quality items that are free from defects, fit for their intended purpose, and of good material and workmanship. The specific warranty provisions applicable to this agreement are stated in attachment D.

The City will award purchase orders and contracts to the lowest responsive, responsible bidder.

The bidder must have operated continuously for a minimum of five years as an established firm in providing allweather asphalt mix materials and must submit proof of the required experience with the bid. The bidder must not have any outstanding lawsuits nor have been involved in any lawsuits during the last five years that may materially affect its ability to provide the work described herein. The bidder must not have any outstanding regulatory issues nor had any regulatory issues during the last five years that may materially affect its ability to provide the work described herein.

The bid notice does not explicitly detail penalties for non-compliance, but states that certain behaviors, such as lobbying or failing to adhere to contract terms, can lead to disqualification or termination.

If a protest is filed prior to the bid proposal due date, the city must be notified in writing of the alleged deficiency no later than five days before the due date. If a protest is filed after the bid proposal due date, a written notice of intent to protest must be filed within five calendar days of knowing the facts, and the written protest must be filed within seven calendar days of notifying the city of intent to protest.

Bidders may be disqualified and/or have their bid rejected for reasons including collusion, litigation against the city, arrears on existing contracts, lack of financial stability, failure to perform under previous contracts, failure to use city-approved forms, failure to adhere to RFB provisions, failure to submit bids on time or in the specified format, failure to adhere to ethical principles, failure to provide a cost summary, being debarred or suspended, failure to acknowledge addenda, or failure to provide unit pricing.

The project completion deadline is on or by September 30, 2026.

Project bidder must submit bond requirements either in the bid packet or upon notification of winning the project.
