The government will make award to the lowest priced technically acceptable (LPTA) offeror that provides all required documentation.
The offeror must ensure that your firm is currently registered in SAM at www. ***. *. * at the time of quote submission and at the time of award.
Questions related to this request for quote (RFQ) package must be emailed no later than 10:00 AM Eastern Time, July 20, 2026.
The government reserves the right to reject quotes that are not submitted in accordance with these instructions. The government reserves the right to reject late quotes.

ESD reserves the right to amend, withdraw, or cancel the RFP, or negotiate terms. All costs are at the respondent's expense. Submitted information is subject to Freedom of Information Law. Awarded contracts may be subject to review and approval by the Office of the State Comptroller for contracts over one million dollars. Contractor performance will be assessed based on timely and professional achievement of contractual obligations. Contractor warrants services will be performed according to professional standards and will correct errors at no charge. Additional services may be added by written notice, with equitable adjustments to price and time. Contractor staff are subject to approval, and proposed changes require immediate notification and a summary of experience. Subcontracting requires prior written approval. All personnel must possess necessary qualifications, training, licenses, and permits. Bidders must certify they have not colluded with other respondents. Conflicts of interest must be disclosed. Communications during the restricted period must be with designated contacts. Respondents must be responsible, demonstrating financial ability, organizational capacity, and legal authority. Registration in the state's vendor responsibility system (VendRep) is required. Bidders must certify they are not on the Iran Divestment Act list and are in compliance with Executive Order 16 (prohibiting contracts with businesses in Russia) and Executive Order 177 (human rights law). A gender-based violence and workplace policy certification is required. Respondents agree to nondiscrimination and equal employment opportunity requirements, including reporting on minority and women-owned business enterprises (MWBEs) and workforce utilization. Encouragement is given for participation by service-disabled veteran-owned businesses (SDVOBs) and New York State businesses. Contracts are subject to State Tax Law Section 5a, requiring a ST-220CA form or affidavit. A completed W9 form must be submitted. Debriefing for unsuccessful respondents is available upon request within 15 calendar days of notification. Insurance requirements include commercial general liability, commercial automobile insurance, workers' compensation, and employer's liability insurance.
Contractor warrants that its services shall be performed in accordance with applicable professional standards and that the contractor shall correct, at no charge to the corporation, services which fail to meet applicable professional standards and which result in obvious or patent errors in the progression of its work.
Respondents must be responsible, demonstrating financial ability, organizational capacity, and legal authority to carry out obligations, and must show satisfactory performance of all prior government contracts. Contractor staff assigned to the project must possess the necessary experience, knowledge, and character.
If a respondent is found to have knowingly and willfully violated State Finance Law provisions, that respondent and its subsidiaries, related or successor entities will be determined to be a nonresponsible respondent and will not be awarded any contract issued pursuant to this solicitation. In addition, two such findings of nonresponsibility within a four-year period can result in debarment from obtaining any New York State governmental procurement contract.
ESD may disqualify any respondent to this RFP or terminate any contract entered into as a result of this RFP should ESD determine that the respondent has violated any of the conflict of interest provisions. If a respondent is found to have knowingly and willfully violated the State Finance Law provisions, that respondent and its subsidiaries, related or successor entities will be determined to be a nonresponsible respondent and will not be awarded any contract issued pursuant to this solicitation.
