Delivery dates and times are specified on Attachment A. Delivery dates and/or times can be altered unilaterally by the government if the proposed time is between Monday and Friday between 8am and 4pm local time. The contractor may propose an alternative delivery date and/or time but will only be effective if mutually agreed upon between the contractor and COR or ordering activity.

Payment will be made by the Department of Veterans Affairs via Tungsten Electronic Invoicing. Invoices shall be submitted in arrears upon delivery and acceptance.

The contractor warrants and implies that the items delivered under this contract are merchantable and fit for use for the particular purpose described in this contract.

This procurement is a total set aside for service disabled veteran owned small businesses, however, it is also a tiered cascading evaluation. Tier one evaluation: certified SDVOSBs. Tier two evaluation: certified small businesses. Tier three evaluation: other than small businesses. If the government determines award cannot be made at a tier, it may proceed to evaluate eligible quotations from the following tier.

Offerors shall be registered and active at System for Award Management (SAM) at time of offer. Quotes will only be accepted from responsible contractors.

Failure of the contractor to meet routine nonemergent delivery criteria shall be reported to the COR and CO. Continuous backorders or backorder cancellations without acceptable justification may be considered for termination of the contract. Failure to meet the 95% fill rate performance metric will result in a contract deficiency report (CDR).

Failure to meet performance metrics, continuous backorders or cancellations without justification, or failure to comply with contract terms and conditions may lead to disqualification or termination.

An onsite inspection must be conducted prior to design and installation.

Delivery of compressed gases during the period of performance of 12 months from the date of award of the purchase order.

Payment terms of net 30. Invoices to be billed in arrears via ipp.

The government intends to award a low priced, technically acceptable, single award firm fixed price purchase order on an all or none basis.

This acquisition is set aside for small business concerns. The associated naics code is 325120. The small business size standard is 1,200 employees.
