Proposals will be evaluated based on past performance and experience (35%), qualifications and experience of proposed staff (25%), quality of the proposal (25%), and business organization, references, litigation, and responsiveness (15%).

Qualified firms must demonstrate financial resources, compliance with performance schedules, a record of past performance, ability to provide necessary personnel and management capability, and be licensed by the Texas Board of Professional Engineers and Land Surveyors.

Invoices shall reference the task order number, identify services performed, and include supporting documentation. Failure to comply may delay or prevent payment.

Proposals will be evaluated based on the City's determination of overall value, considering qualifications, experience, technical understanding, responsiveness, past performance, and reasonableness of proposed rates.

Proposals shall include firm qualifications and experience, key personnel qualifications and certifications, relevant project experience, understanding of City requirements, and description of approach to services.

Failure to meet response and performance requirements may result in reassignment or other remedies. Failure to comply with drug-free workplace requirements may result in suspension of payments, termination of the contract, or debarment.

Material sampling is an authorized bid item, compensated per unit when specifically authorized and limited to the tests identified in the task order.

Protests must be submitted within five 5 calendar days of notice of intended award and must include detailed legal and factual grounds with supporting documentation.

Proposals that are incomplete, contain material omissions, or fail to conform to the RFP requirements may be deemed nonresponsive. Failure to provide requested evidence of responsibility may result in rejection.

For contracts under $150,000, the district will pay monthly estimates less 5% retainage, with final payment upon completion and acceptance. If, within one year after substantial completion or acceptance, any work is found to be defective, the contractor shall correct it promptly. The contract will be awarded to the lowest conforming, reliable and responsible bidder, provided the bids are reasonable and do not exceed available funds. The district reserves the right to reject any or all bids, to accept other than the lowest bid and to waive any informality or irregularity in any bid received.

Bidders must submit a Statement of Qualifications, answering all questions comprehensively. The district will award the contract to the lowest, reliable, responsible, and qualified bidder. All bidders are reminded that a contract for work described in the contract documents will be awarded to the lowest, reliable, responsible and qualified bidder as determined by the district.

Liquidated damages in the amount of $1,**** per working day will be deducted if the work is not completed within the specified time limits. All bidders must be licensed contractors and eligible to bid contracts in the state of Tennessee.

In case of default of the contractor, the city may procure the articles of services from other services and hold the contractor responsible for any excess cost occasioned thereby.

All bidders must satisfy themselves by personal examination of the locations of the proposed work.

No withdrawal or modification will be permitted for 60 days after the hour and date designated for opening the bids.

Proposals which are incomplete, unbalanced, conditional, or obscure or which contain additions not called for, erasures, alterations or irregularities of any kind or which do not comply with the invitation to bid and information for bidders may be rejected at the option of the city.
