Time is of the essence. If delivery of conforming goods or performance of conforming services is not completed by the times promised, the city reserves the right to cancel this contract, to reject such goods or services, and to purchase substitute goods or services elsewhere and charge the contractor with any loss incurred by the city.

Payments shall be paid to contractor within thirty (30) days contingent upon receipt of properly documented invoices and delivery of goods or performance of services to the satisfaction of the city.

All goods and services covered by this contract shall conform to specifications, be merchantable, fit for purpose, of best quality and workmanship, and free from defects. The city has the right to inspect and reject defective goods or require re-performance of services at the contractor's expense.

The city may compare quotes based on prices for individual line items, categories, aggregate price, or other award basis that is most advantageous to the city. Award will be made to the lowest offer meeting any minimum requirements.

The lowest offer will be reviewed to ensure any minimum qualifications stated in this solicitation are met. The city reserves the right to require references from the lowest offeror prior to contract award to confirm minimum qualifications.

If delivery is not completed by the times promised, the city reserves the right to cancel the contract, reject goods or services, and purchase substitutes elsewhere, charging the contractor with any loss incurred.

Offerors shall notify the person listed on the cover sheet in writing of any omissions, ambiguities, inconsistencies or errors in the solicitation prior to the offer due date and time.

Offerors that do not check the box indicating compliance with the nondiscrimination and nonretaliation certification shall be determined nonresponsive. Noncompliance with chapter 54 of the city code may result in sanctions, including termination of the contract and suspension or debarment.

Offers are due Tuesday, August 4, 2026, 2:00 PM CT.

All proper invoices received by the City will be paid within 30 calendar days of the City's receipt of the deliverables or of the invoice, whichever is later.

The purchase includes a 5-year warranty for each device.

The city will evaluate bids based on best value to the city, including consideration of offerors' headquarters, local businesses, and size (small businesses). Discounts are applied for local and small businesses.

Offerors must be responsible, meaning they have the financial and practical ability, resources, expertise, past performance, and a positive compliance history with all city ordinances.

Protests regarding the solicitation must be filed no later than five business days before the opening of bids. Protests regarding the evaluation of bids must be filed no later than five business days after the opening of bids. Post-award protests must be filed no later than ten business days after the date of award.

Offers taking exceptions to any portions of the solicitation will cause the city to reject the offer entirely. Bids that are not minimally responsive will be rejected. Offerors found to be non-responsible will have their bid set aside.
