First delivery or will call shall occur after the issuance of a purchase order. Specific delivery dates will be indicated in the purchase orders and must be confirmed with ODOC warehouse receiving staff.

Payment is normally made within 30 days following the date the entire order is delivered and accepted or the date the invoice is received, whichever is later. After 45 days, contractor may assess overdue account charges up to a maximum rate of two-thirds of one percent per month (8 APR) on the outstanding balance.

All implied and expressed warranty provisions of the Uniform Commercial Code (ORS Chapter 72) are incorporated. Contractor warrants that all goods shall be new, unused, current production models, free from defects in materials, design and manufacture for the duration of the contract.

Award will be made to the responsible bidder submitting a responsive bid with the lowest total price, considering preferences for Oregon goods/services and resident bidders.

Bidders must submit bids that conform to the requirements of the ITB, including all required information and certifications. ODOC reserves the right to investigate and evaluate a bidder's responsibility to perform the contract.

Failure to comply with contract provisions, including tax laws, may result in contract termination and liability for damages. Late or misdirected samples may result in bid rejection.

ODOC reserves the right to request samples after bid closing from one or more bidders during the evaluation process. If requested, bidders shall deliver samples within four days after the date of the request.

Requests for clarification or changes to contractual terms or specifications must be received by the deadline specified in the Schedule of Events (July 17, 2026, at 9:00 AM PST). Protests, if allowed, must also be received by this deadline.

Contact with other ODOC staff regarding this ITB without prior clearance from the single point of contact will lead to disqualification. Failure to supply all required information may be cause for bid rejection.

If contractor fails, neglects or refuses to pay promptly as due, any claim for labor or services furnished to the contractor or any subcontractor by any person in connection with the goods provided under this contract, the state may pay such claim and charge the amount of the payment against funds due or to become due the contractor under this contract.
