Cherokee County Board of Commissioners is requesting sealed bids for a road repair project. The project involves road repair and includes work detailed in various specifications and documents. The contractor must be licensed and registered in Georgia. The agreement includes provisions for contract term, liquidated damages for delays, expediting completion, and contractor compensation. Insurance and performance/payment bonds are required. The county reserves the right to order changes and terminate the agreement for convenience or cause. The contractor is responsible for all work and indemnifies the county. The agreement is governed by Georgia law.
The parties intend that all work shall be completed on or before days weeks following the commencement date specified in the notice to proceed. Every effort will be made by contractor to shorten this period.
Additional payment requirements are included as exhibit E, attached hereto and incorporated herein by reference.
The contractor warrants to the county and the contract administrator that materials and equipment furnished under the agreement will be of good quality and new, unless otherwise required or permitted by the contract documents, that the work will be free from defects not inherent in the quality required or permitted, and that the work will conform to the requirements of the contract documents.
Contractor must be licensed and registered to do business in the state of Georgia. Contractor must employ only persons duly qualified in the appropriate area of expertise to perform the work.
Contractor shall pay to the county US dollars . 00 for each and every calendar day that expires after a deadline provided in the contract documents, as liquidated damages for delay but not as a penalty.
Samples are physical examples that illustrate materials, equipment or workmanship and establish standards by which the work will be judged. The contractor shall review for compliance with the contract documents and shall approve and submit to the contract administrator shop drawings, product data, samples, and similar submittals required by the contract documents.
Consistent failure to participate in problem resolution meetings, two consecutive missed or rescheduled meetings, or failure to make a good faith effort to resolve problems, may result in termination of the contract for cause.
