All contract work shall be substantially completed no later than 350 calendar days from the notice to proceed (NTP), and final completion shall be 365 calendar days from NTP.

Payments will be made to the contractor on the 30th day of each month, with a five percent (5%) retainer. The owner may pay in advance for mobilization to meet ARPA funding expenditure deadlines.

A two (2) year extended warranty is required for the owner-procured return activated sludge (RAS) pumps, commencing on the date of procurement.

The award will be based on the unit prices submitted in the bid forms, with the total bid determining the award.

Bidders must have carefully examined all contract documents, visited the project site, and satisfied themselves as to the nature and location of the work.

Liquidated damages will be assessed in accordance with MDOT subsection **** of the standard specifications for construction for failure to complete the work on time.

Bidders shall carefully examine the existing WWTP, utilities, grit system, site access, electrical systems, process piping, and structural conditions. Failure to inspect the site shall not relieve the contractor from completing the work.

Questions regarding the request for bid shall be submitted on or before July 31, 2026, at 5:00 p. m.

The owner reserves the right to reject any or all bids, including bids from unqualified bidders or those of doubtful financial ability.

Sealed proposals will be received until 10:00 a. m. , local time on Friday, July 31, 2026.

The successful bidder will be required to furnish a maintenance and guarantee bond in the amount of 100% of the project prior to award.

All questions shall be submitted in writing by Friday, July 24, 2026 by 5pm.

Bids submitted after the exact time specified will not be considered.

Bids will be received until 2:00 p. m. local time on July 13, 2026.

There will be no mandatory prebid job walk, however the village manager will be available on Wednesday, July 8, 2026 at 9:00 a. m. and Thursday July 9, 2026 at 3:00 p. m. at the village hall to answer any questions and walk the site. The village encourages contractors interested in this project to visit the site to better understand the scope of the work.

The bid form states that the work will be complete prior to the close of asphalt plants, 2017.

The agreement states that owner shall make progress payments on account of the contract price on the basis of contractors applications for payment on or about the 10th day of each month during performance of the work.

Contractor warrants and guarantees to owner that all work will be in accordance with the contract documents and will not be defective.

The owner intends to award a contract to the lowest responsible bidder provided the bid has been submitted in accordance with the requirements of the bidding documents and does not exceed the funds available.

The owner requires the bidder have a minimum of 5 years experience in this type of commercial construction.

Liquidated damages for failing to timely attain substantial completion and final completion are not additive and will not be imposed concurrently. Contractor shall pay owner $100 for each day that expires after the time as duly adjusted pursuant to the contract specified for substantial completion until the work is substantially complete.

There will be a mandatory prebid conference.

Contractor shall submit samples as required by the individual specification sections or at the request of the owner or rpr at no additional cost to the owner.

Contractor may submit a change proposal regarding its entitlement to or the amount or extent of any adjustment in the contract price or contract times, or both, no later than 30 days after owners issuance of the owners written statement to contractor regarding the subsurface or physical condition in question.

Failure to fill in items on the bid form may be considered an incomplete bid.
