The warranty will cover the completed product and all parts, including labor, materials, and parts required to repair faults or defects. The warranty period will begin on the date the product is accepted and continue for at least 1 year or the duration of the manufacturer's standard warranty, whichever is longer. Contractors warranty obligations will survive the termination of this contract.

CPA will determine best value for the state, considering compliance with specifications, purchase price, and risk of vendor nonperformance. Items awarded will be made on the basis of best value, with primary consideration being given to the lowest total evaluated bid price.

CPA may disqualify a respondent if there is an unacceptable risk that it will fail to perform the contract. The respondent bears the burden of establishing ability, capacity, skill, promptness, character, responsibility, integrity, current compliance with laws, sufficient financial resources, and conformity to material specifications.

If nonpayment of the Texas SmartBuy administrative fee reaches 90 days, the contractor may be placed on warrant hold. Time is of the essence in performance of this contract. CPA and the customer may exercise contractual remedies in connection with late delivery.

Communicating with anyone other than the point of contact listed may result in disqualification. Failure to submit required documentation, including the execution of response, mandatory price sheet, or identification of confidential information, may lead to disqualification. Including exceptions or assumptions that materially change specifications can also result in disqualification.

Delivery is required by July 9, **** refrigerated trailers dropped on 9 july 2026 in order to accommodate ice deliveries and refrigerated food items.

The contract will be awarded to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the government, price and other factors considered. Payment for disposal costs incurred by the contractor at permitted final disposal facilities will be made at the cost incurred by the contractor as a pass-through cost without mark-up. Contractor must submit a copy of the invoice received by the disposal facility, an electronic copy tabulating all scale or load tickets, and proof of contractor payment.

Proposals will be ranked based on experience (25 points), management team (20 points), resources (20 points), project approach (15 points), and fees (20 points).

The contractor must be duly licensed in accordance with the state of Oregon's statutory requirements. Proposers must be prepared to submit copies of all required licenses, certifications, and any other statutory requirements prior to signing a contract.

Providing incorrect or incomplete information in the proposal may be cause for rejection of the proposal or contract termination.

The response to this solicitation is due no later than 02/06/2027 at 2:00 PM.

The award will be made to the lowest responsible vendor meeting the specifications and all terms and conditions.
