Responses must be received by July 13, 2026, 10:30 AM Central Time.

Payment will be made in accordance with Chapter **** of the Texas Government Code, the Texas Prompt Payment Act. Invoices must include the contract or purchase order number and describe the work completed.

Exhibit 2 of the IFB is titled Warranty Resolution.

Award will be made to the bidder who provides the best value to the state, considering meeting or exceeding requirements and specifications, ability to meet performance delivery requirements, and price.

To be considered for award, bidders must submit a comprehensive response including all required information and documentation to ensure they meet all requirements, possess the required experience and qualifications, and have the capacity to provide the goods and/or services.

HHSC reserves the right to purchase late items on an emergency basis and charge any resulting increase in price and any additional delivery charges to the awarded contractor.

FOS NFS may request product samples.

Texas Administrative Code, Title 1, Part 15, Chapter 391, Subchapter C provides a formal protest procedure.

Failure to comply with IFB instructions, submission requirements, or providing incomplete information may result in disqualification. Including assumptions in a response could also lead to disqualification.

Respondents must be responsible small businesses with annual revenues of $9. 0M or less, as defined under NAICS code ****.

Delivery will be made within 7-10 days ARO (After Receipt of Order) on a called-for, as-needed basis.

Payment is to be made within 30 days after receipt of properly executed invoice or delivery, whichever is later.

The manufacturers standard warranty will apply unless otherwise specified in the solicitation.

It is the intent of the state to award this contract on an individual basis to the lowest responsive, responsible bidders meeting the specifications.

Bidders must be registered in the LAGOV system. Corporations and LLCs must be registered and in good standing with the Louisiana Secretary of State for contracts over $25,000.

Failure to deliver within the time specified or to provide services as specified will constitute a default and may cause cancellation of the contract. The state may purchase on the open market and charge the contractor for excess costs.

Bids may be rejected if they do not meet specifications, if the bidder has been convicted of certain felonies related to public contracts, or if the bidder is suspended or debarred.

Responses must be received by July 11, 2026, 10:30 am CT.

Failure to comply with IFB instructions, submission requirements, or deadlines may result in disqualification. This includes not submitting required exhibits, incomplete responses, or late submissions.

The estimated historical spend for the period September 1, 2025 - August 31, 2026, was $1,500,****.

Proposals must be electronically uploaded by Tuesday, July 7, 2026, at 10:00 AM prevailing time.

Award shall be made to the responsive, responsible concessionaire whose proposal is determined to be the most advantageous to the city, based on lease fee (25%), experience (25%), safety staffing (20%), menu (10%), action plan (10%), and additional information (10%).

Proposers shall have demonstrated ability and experience in the operation of a concession foodservice business, with a minimum of three years of experience required. A record of past experience and references must be supplied.

A contractor, subcontractor, or supplier who fails to provide proof of business registration or provides false business registration information shall be liable to a penalty of **** for each day of violation, not to exceed $50,000 for each business registration not properly provided or maintained.

Respondents shall be eliminated from competition if they do not meet applicable federal, state, or county legal requirements. Failure to provide proof of business registration or providing false information can result in penalties. Failure to remedy defaults within five days of notice can lead to contract termination.
