The bid proposal states that all work under this contract will be fully completed within 90 consecutive calendar days from the date of written notice to proceed.

Protests must be submitted in writing within five (5) working days after the aggrieved person knows or should have known the facts giving rise thereto, provided that a protest based upon the content of the solicitation shall be submitted in writing prior to the date set for receipt of offers. Further provided that a protest of an award or proposed award shall be submitted within five (5) working days after the posting of the award of the contract.

The estimated cost of construction is $1,900,****.

The sealed bid must be received in its entirety by the City of Saratoga Springs, Office of the Commissioner of Accounts, by Tuesday, May 19, 2026, at 2:00 PM.

This invitation for bid will be awarded on an item-by-item basis to the responsive and responsible bidders offering the lowest price for each item.

The city may consider as not responsible any bidder who does not habitually perform with their own forces at least fifty percent (50%) of the dollar value of the work involved in the contract.

Failure to comply with any of the above terms or any evidence of poor quality or service will be considered cause of discontinuing business with the successful bidder.

Bids are due by 2:00 p. m. on Thursday, May 7, 2026.

The district will pay the contractor ninety-five 95 percent of the amount of each properly submitted and undisputed progress payment request. Five 5 percent of the amount of each payment request shall be retained by the district until final completion and acceptance of all work under the contract.

The contractor unconditionally guarantees all materials and workmanship furnished hereunder, and agrees to repair or replace or both at its sole cost and expense, and to the satisfaction of the engineer and the district, any and all materials which may be defective or improperly installed. The guarantees and warranties shall remain in effect for one year from the date of recording a notice of completion.

The award of the contract, if it is awarded, will be to the lowest responsible and responsive bidder whose bid complies with the requirements of the contract documents.

Bidders must comply with the instructions to bidders in the contract documents. The successful bidder must possess a Class A, General Engineering, contractor's license issued by the state of California. Bidders must be registered and qualified to perform public work with the department of industrial relations.

The contractor shall forfeit as penalty to the district not more than the sum of two hundred dollars $200 and not less than forty dollars $40 for each calendar day or portion thereof for each worker paid less than the stipulated prevailing rates. Failure to execute the contract after award may result in forfeiture of the bid bond.

A mandatory prebid conference will be held on Tuesday, April 21, 2026 at 9:00 a. m. local time at the site of the project, **** La Vista Avenue, **** is suggested that each prospective bidder review the bid documents and project site prior to the prebid conference.

The contractor shall furnish, without additional cost to the owner, such quantities of construction materials as may be required by the engineer for test purposes.

Any bid protest must be submitted in writing to the district before 5:00 p. m. of the fifth working day following the bid opening.
