The city shall pay to the contractor and the contractor guarantees that the maximum amount payable by city as full compensation for services under this agreement, including preliminary stage design and construction, will not exceed to be determined the guaranteed maximum price, subject to increases or decreases for changes in the scope of work properly authorized pursuant to the terms of this agreement.

For one year after the date of final payment, the contractor shall maintain and repair the work. Any work which is found to be defective shall promptly and without cost to the city and in accordance with the citys written instructions, be corrected or replaced with nondefective work.

The contractor specifically represents and agrees that its officers, employees, agents and consultants have and shall possess the experience, knowledge, and competence necessary to qualify them individually for the particular duties they perform hereunder.

If contractor wishes to make a claim for an increase in the guaranteed maximum price, an increase in its fee, or an extension in the completion dates, it shall give city written notice thereof within number of days days after the occurrence of the event giving rise to such a claim.

If the contractor does not promptly repair or replace the work pursuant to the citys directions, the city may itself correct the defective work or may have the defective work corrected by another contractor. The contractor shall pay all of the citys costs and expenses, including city employee costs associated with the repair or replacement of the defective work.

The bid submission deadline is Tuesday, May 26, 2026, at 2:00 PM. The bid responses must be emailed to tcmanage@traversecitymi. gov.

The City prefers a monthly retainer but will consider all pricing structures submitted. Proposals should include the proposed pricing structure, including monthly retainer rate and hourly costs for additional work.

The bid will be evaluated and awarded on the basis of the best value to the city. The criteria used by the city may include, but will not be limited to: experience, price, availability, and other pertinent factors and overall capability to meet the needs of the city.

Minimum qualifications include at least five years of responsible experience as a practicing attorney, with at least three years involving municipal or other government law practice and litigation/trial experience. Specific experience is required for Michigan Tax Tribunal and labor/employment matters. Attorneys must be licensed in Michigan and in good standing with the Michigan Bar Association.

The bid notice does not mention the submission of samples.

Questions regarding the bid must be submitted by Monday, May 18, 2026.

The bid submission deadline is Friday, May 15, 2026, at 10:00 a. m. The contract period is for three years starting July 1, 2026, and ending June 30, 2029.

Payment shall be made within thirty (30) days of satisfactory completion of the work. The city may withhold payment for defective work, damage to city property, or failure to obtain or maintain proper permits and insurance.

The city intends to select bids on the basis of: qualifications, ability, relevant experience, type and amount of necessary equipment, highest financial benefit to the city, operation best suited to provide services desired, possession of proper required insurance, licenses, permits, etc. , and other pertinent factors it may deem necessary.

Bidders must provide proof of all insurance, references, and a completed bid summary sheet. The city prefers companies with at least 25 employees on active payroll for the past three years and those in business for 10 or more years.

Upon unsatisfactory service, the contractor shall be notified, and unless corrections are immediately completed within eight (8) hours, liquidated damages in the amount of **** per separate daily occurrence per issue shall be paid by the contractor. The contractor will also deduct, from the monthly invoice, one day cleaning fee, for each facility left unlocked.

Prior to submission of the bid, the contractor/vendor will be required to do a mandatory walkthrough of each of the properties to be cleaned on May 6, 2026, starting at 9:00 a. m.

The contractor must provide product samples for approval prior to use within the city buildings.
