The successful proposer shall submit separate invoices monthly for the previous months services. Payments will be made only upon the completion of services or after the delivery of goods authorized in an approved invoice.

The successful proposer warrants and agrees that all goods and services it supplies in its performance under the contract shall meet the performance standards required thereunder and shall be performed in a prompt, high quality, professional and competent manner using only qualified personnel.

At a minimum, the factors to be considered by the evaluation committee in evaluating proposals shall include: he proposers price to provide the goods or services, the probable quality of the offered goods andor services, the agencys evaluation of the likelihood of the proposal to produce the desired outcome for the agency, considering, among other criteria: the quality of the proposers past performance in contracting with the agency, with other state entities, or with private sector entities, the qualifications of the proposers personnel, the experience of the proposer in providing the requested goods or services, the financial status of the proposer and whether the proposer performed the good faith effort required by the hub subcontracting plan, when the agency has determined that subcontracting is probable.

Proposers auditors must be certified public accountants cpas and maintain in good standing, an active license issued by the texas state board of public accountancy. Proposers must provide evidence of licensure with submission of proposal.

The failure of the successful proposer to provide the texas department of licensing and regulation with accurate or complete reports and data may result in the successful proposer being assessed liquidated damages in the amount of two thousand five hundred dollars 2, 500 per incident of reports with inaccurate data and one hundred dollars 100 per day for incomplete reports.

The texas department of licensing and regulation, in its sole discretion, reserves the right to conduct site visits andor to require proposers to make oral presentations prior to the contract award and may consider such presentations and visits when evaluating proposals.
