Delivery will be made within 2 days ARO (After Receipt of Order) on a called-for basis.

Payment is to be made within 30 days after receipt of properly executed invoice or delivery, whichever is later. Discounts for payment made within 30 days. Discounts for payment made in less than 30 days, of less than 1%, or applicable to an indefinite quantity contract will be accepted but will not be an award consideration.

The contract will be awarded on an all-or-none basis to the overall lowest responsive, responsible bidder meeting the specifications.

Vendors must be registered in the LAGov system to submit bids and have their bids tabulated. Bidders must be responsive and responsible and meet the specifications.

Failure to deliver within the time specified or to provide services as specified will constitute a default and may cause cancellation of the contract. The state reserves the right to purchase on the open market and charge the contractor for excess costs.

Bids may be rejected if delivery time is longer than specified. Failure to comply with laws, regulations, or contract provisions can lead to termination. Misrepresentation, fraud, or abusive conduct are grounds for termination.

Responses must be received by August 12, 2026, 10:30 am.

Payment will be made in accordance with chapter **** of the Texas Government Code, commonly known as the Texas Prompt Payment Act.

Award will be made to the bidder who provides the best value to the state, considering bidder meeting requirements, ability to meet delivery, and price.

The contract will be a firm fixed price contract. Commissions will be remitted monthly by the fifteenth business day following the end of the month. The supplier shall remit the monthly commission due to participating school locations on or before the fifteenth business day following the end of the month.

Payment terms are Net 30. Invoices will be paid within 30 days from the date of receipt and approval of invoices. The district will not pay interest on delinquent payments.

For supply contracts, all supplies furnished will be free from defects in material or workmanship for no less than one year from the date of acceptance. For service contracts, all services performed will be free from defects in workmanship at the time of acceptance.

Award will be made to the responsible supplier whose proposal is most advantageous, considering price, past performance, financial stability, and technical capability. Key criteria include pricing (75 points), responsiveness (25 points), product evaluation (50 points), service delivery (10 points), and references (10 points).

Suppliers must be responsive and responsible, meaning their proposals meet requirements and they have the means to execute the procurement. Factors considered include experience, integrity, reliability, capacity, and financial stability.

Failure to meet on-time delivery standards may result in corrective action, including written notice, a corrective action plan, conditional continuation of the contract, cost recovery, or contract termination for cause.

A pre-proposal conference may be held, which is encouraged but not mandatory. The format will be an overview of the RFP with an opportunity for questions.

Physical samples of equal products and all supporting documentation must be received no later than July 27, 2026, 2:00 PM MST. Samples must be submitted in original standard packaging.

Proposals may be rejected if they do not comply with RFP requirements, if they are submitted late, or if the supplier is debarred or suspended. Failure to disclose minimum order requirements can also lead to non-responsiveness.
