HHS system agency will make contract payments in accordance with chapter **** of the Texas Government Code, commonly known as the Texas Prompt Payment Act.

Sensors have a 5-year warranty with 2 no-questions-asked replacements per sensor. The panoramic X-ray has a 5-year parts warranty on all parts, with the sensor and tubehead having a 10-year warranty for parts. Midwest will have a 6-month warranty on all labor.

All responses will be evaluated according to the following criteria: bidder meeting or exceeding the requirements and specifications, bidders ability to meet performance delivery requirements, and price. The award will be made to the bidder whose response offers the best value to the state.

To be considered for award, bidders must submit a comprehensive response which includes all required information and documentation as outlined in this IFB to ensure the bidder meets all requirements, possesses the required experience and qualifications, and has the capacity to provide the goods and/or services described in this IFB.

The contractor's noncompliance or failure to timely correct a deficiency may result in delayed payment or nonpayment as determined by the HHS agency.

Texas Administrative Code, Title 1, Part 15, Chapter 391, Subchapter C provides a formal protest procedure.

Bidders should not submit exceptions to this IFB which could result in disqualification of a response. No changes to a response can be made after the submission deadline. No assumptions should be included in a response. The inclusion of assumptions could result in disqualification of a response.

The estimated historical spend is $54,****.

The period of performance for delivery is from June 29, 2026, to January 29, 2027.

Payment will be made by the government. Invoices are to be submitted to the address shown in block 18a unless otherwise specified.

Proof of calibration must be valid for no less than three years.

The government will award on the basis of price unless past performance indicates that the lowest price may not represent best value. A price/past performance tradeoff may be conducted.

Offerors must be responsible and provide conforming offers. The NAICS code is **** with a small business size standard of $34,000,****.

Offers will be evaluated based on technical capability, past performance, and price, using a best value trade-off process. Technical and past performance, when combined, are more important than price. The best value trade off process technique will be used.

This is a sole source award, not based on competitive proposals.
