The contractor warrants that for 6 months after receipt of supplies at destination or, in the case of supplies required to bear an expiration date, for the expiration date indicated in the labeling thereof, all supplies furnished are of a quality to pass without objection in the trade under the contract description, are fit for the ordinary purposes for which the supplies are used, are within the variations permitted by the contract, and are of an even kind, quality and quantity within each unit and among all units, are adequately contained, packaged, and marked as the contract may require and conform to the promises or affirmations of fact made on the container.
This procurement is using the low price technically acceptable (LPTA) source selection procedures. The government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the government, price and meeting the requirements of the solicitation considered.
To determine the responsibility of prospective contractors, the government reserves the right to conduct physical surveys of the plants which are to be used in the performance of a contract. In the event the government is prevented from conducting such surveys by the offeror or its proposed subcontractor, the offer may be rejected.
If this contract is terminated in whole or in part for cause, and the supplies or services covered by the contract so terminated are repurchased by the government, the contractor shall pay, and the government shall accept, the sum of 1,**** as payment in full for the administrative costs of such repurchase.
Product Demonstration Models (PDMs) are required for each item while the solicitation is open. PDMs must be received no later than the time set for closing of offers. A total of 30 samples of PDM items shall be submitted as stated in the solicitation.
