The department is exempt from federal excise taxes and all department and local taxes, unless otherwise provided herein. ODOT does not agree to pay any taxes on commodities, goods, or services acquired from any vendor. The department may terminate this contract for various reasons, including breach of contract, unremedied breach, persistent breach, endangered performance, financial instability, delinquency, violation of law, subcontractor breach, vendor's failure to pay material suppliers, failure to maintain MBE certification, failure to maintain licensure, or removal from a qualified products listing. Delays in contract award may result in a change in the contract period. Successful bidders will receive a notice of contract award letter and a photocopy version of the signature page executed by both parties.
