The county's payment terms are net thirty (30) days.

Contractor guarantees for one year from acceptance, or for a longer period expressly stated in the solicitation, all goods, services, and construction offered, including a guarantee against defects. The contractor must correct any defects at no cost to the county.

The award will be based on a combined score from written proposal evaluation and interview evaluation, considering demonstrated program superiority, technical approach, provider network, reporting capabilities, price proposal, performance guarantees, local business preference, and MFD participation.

The contractor must have a minimum of seven years of experience in administering employee assistance program and related services for public sector clients of similar size and complexity, including experience supporting public safety populations.

Any offeror who is aggrieved may file a protest within ten (10) days after the director, office of procurement, publicly posts the proposed contract award, or before the solicitation proposal submission due date and time if seeking cancellation or amendment.

Failure to complete and submit required wage requirements forms may result in the proposal being unacceptable and rejected. Failure to rectify a forfeit status with MDSAT may result in the firm being declared nonresponsible and its proposal rejected.

Bids shall be electronically uploaded no later than June 11, 2026, at 11:30 a. m. prevailing time.

Payment will be made in accordance with the County of Mercer's policy and procedures. The county pays vouchers biweekly, typically within 30 days if all documentation is compliant.

The contract shall be awarded to the lowest responsible bidder.

Respondents must provide a company overview, references of equivalent size or greater, and detailed information on benefits administration, implementation, account management, provider network, customer service, and claims processing.

Respondents shall provide plan literature and enrollment forms and shall submit sample documents with their bid proposal response.

Any prospective bidder who wishes to challenge a bid specification shall file such challenges in writing with the contracting agent no less than three business days prior to the opening of the bids.

Failure to submit any of the required items in the bidders document checklist is a mandatory cause for rejection of bid. Bids may be rejected for various reasons including unbalanced bids or prior negative experience.

The awarded vendors shall deliver all stocking items under the terms of these contract specifications within twenty-four (24) hours of order placement.

Payment shall be processed upon submission of a written invoice in a form satisfactory to the county. The county encourages entities with which the county does business to use electronic payment via ACH. Awarded vendors will be requested to receive payments through ACH.

The award of the contract will be made to the lowest priced responsible bidder which has complied with the specifications.

A responsible bidder is a manufacturer, producer, dealer, vendor, or bona fide manufacturers agent who the county determines has demonstrated judgment and integrity, is of good reputation, experienced in his work, whose record of past performance in the trade is established as satisfactory, and whose financial status is such to provide no risk to the county of Dutchess in its contractual relations.

In case of default of the contractor, the county may procure the articles or services from other sources and charge the contractor as liquidated damages any excess cost or damages occasioned thereby.

Samples may be requested by the county for the purpose of product evaluation. It is understood that samples will be provided at no charge to the county by the vendor.

Any protest to the division of central services consideration of any bid must be submitted in writing and received by the director of central services no later than five (5) calendar days after the bid award.

Failure to acknowledge receipt of all amendments may deem the bidder as nonresponsive. Bids submitted in pencil will be rejected as unresponsive. Bids which have been corrected by white out or cross out and have not been initialed and/or dated will be rejected as unresponsive.

The bid notice states that delivery and/or completion will be made within twelve 12 days from the date of notification if the bidder fails to indicate a date of delivery and/or completion. For the overall contract, the period is three 3 years from July 1, 2026, through June 30, 2029.

The bid notice mentions prompt pay discounts will be considered when determining the low bid, except when discounts are for a period of less than 30 days. It also states prompt pay discount 30 days, net 45 days.

The bid notice states that the bidder to whom a contract is awarded guarantees to the city of Worcester all equipment, materials and or workmanship for a period of one 1 year after final inspection and acceptance and shall replace promptly any defective equipment, materials andor workmanship required without additional cost to the city. It also specifies that all parts must have a minimum oneyear unconditional warranty, including electrical parts.

The bid notice states that the procurement officer shall award the contract to the lowest responsible and responsive bidder. For Category 1 (non-OEM parts), awards will be based on the highest discount percentage on each parts pricing section, with bidders receiving points based on their discount ranking. Multiple awards are possible.

The bid notice states that the term responsible bidder means a person who has the capability to perform fully the contract requirements, and the integrity and reliability which assures good faith performance. It also mentions that additional scrutiny is justified, which may entail consideration of the contractor's system of oversight, training, and supervision of its employees, including customer service and courtesy, and care and diligence in hiring and assigning employees.

The bid notice states that if any bid is withdrawn after the time and date specified, the bidder shall forfeit the bid deposit as liquidated damages. It also mentions that if the successful bidder fails to make delivery or complete the contract within the time specified, the city reserves the right to make the purchase on the open market and charge any excess over the contract price to the account of the successful bidder. Violation of certain provisions, such as engaging in illegal or offensive behavior, shall be grounds for immediate and unilateral termination of the contract.

The bid notice states that samples of the product to be delivered may be taken by a city representative, either prior to delivery or while it is being delivered, or from storage facilities. The bidder agrees to furnish the necessary manual labor to assemble physical samples under the direction of the city representative. Any product not meeting the requirements after sampling and analysis may be cause for contract cancellation.

The bid notice states that any prospective bidder requesting a change in or interpretation of existing specifications or terms and conditions must do so within five 5 days (Saturdays, Sundays, and holidays excluded) before the scheduled bid opening date.
