Failure to state delivery time obligates respondent to deliver in 14 calendar days. Time limits will be strictly construed and rigidly enforced.

The state will incur no penalty for late payment if payment is made in 30 or fewer days from receipt of goods or services and an uncontested invoice. Payment and remedies for late payment and nonpayment shall be made in accordance with the Texas Prompt Payment Act.

Manufacturers standard warranty shall apply unless otherwise stated in the IFB.

Evaluation of bids will begin as soon as practical after receipt. Evaluation adheres to the best value standard. The state reserves the right to make an award on the basis of low line-item offer, low total of line items, or in any other combination that will serve the best interest of the state of Texas.

Respondents must comply with all rules, regulations, and statutes relating to purchasing in the state of Texas. Each employee of respondent, including replacement employees, will possess the qualifications, education, training, experience and certifications necessary to perform the services.

In the event a successful respondent fails to perform services or complete the obligations under the contract in a timely manner, the state may require the respondent to pay, as liquidated damages and not as a penalty, an amount equivalent to 2% of the total cost for services or obligations not completed as required by the contract per calendar day of delay.

Samples, when requested, must be furnished free of expense to TJJD. If not destroyed in examination, they will be returned to the respondent, upon request, at respondent's expense.

Failure to sign the bid will disqualify the bid. Late and/or unsigned bids will not be considered. Copyrighted bids are unacceptable and are subject to disqualification as nonresponsive.

Dedicated shipments of balls are required monthly on the 15th of the month.

The town is hereby requesting qualified vendors to submit competitive bids.

The desired delivery is seven (7) calendar days after the receipt of a properly executed order. Delivery shall be no later than seven (7) calendar days after receipt of a properly executed order. Failure to adhere to this requirement will result in the termination of the agreement for breach.

Bidders must respond online utilizing the e-bid system. Emailed/faxed copies will not be accepted. Bidders must complete and upload the Substitute W9 Plus form and the Federal Work Authorization Program Affidavit.

The district may enforce any and all penalties available under local, state, and/or federal law for employing an unauthorized alien. Failure to adhere to the delivery requirement will result in the termination of the agreement for breach.

If needed, samples will be requested via email after the bid has closed. Samples should be sent promptly after requested. The district will not be responsible for any payment or fees associated with the requested samples. All samples will be sent at the bidder's expense.

Contacting district staff and/or members of the board of education other than the buyer of record violates policy and is strictly prohibited. Taking exceptions and/or deviations may deem your response as nonresponsive. Failure to certify noncollusion will render the bid nonresponsive.
