Contractor must provide Tceq with a written objection to any notice of interpretation no later than five (5) business days from the effective date of the notice.

If contractor is debarred by the state of Texas or is subject to suspension, debarment, exclusion, disqualification, or similar ineligibility determined by any federal, state or local government entity, Tceq may terminate this contract for cause.

The government will determine whether to proceed with the sole source acquisition after consideration of submitted capability statements, proposals, or quotations.

Interested parties must be certified in the Joint Certification Program (JCP), have an active System for Award Management (SAM) account, and an approved DD 2345. The data custodian in JCP must sign and submit the non disclosure agreement.

If a contractor consistently needs to substitute or refuse to substitute products, the procurement officer reserves the right to terminate the contract and/or initiate suspension and debarment procedures.

Any protest shall be submitted in writing within five 5 working days after the aggrieved person knows or should have known of the facts giving rise thereto, provided that a protest based upon the content of the solicitation shall be submitted in writing prior to the date set for receipt of bids.

Failure to provide valid compliance certificates on a timely basis for award of a contract may result in a bidder not receiving the award. Failure to provide and keep in force required insurance shall constitute a material default under the contract.
