Failure of the contractor to deliver within the time stipulated or to make replacements of rejected articles when requested shall constitute authority for the city to purchase in the open market and the contractor shall reimburse the city for any excess expense incurred.
Samples submitted by bidders on items which they have received an award may be retained by the city until the delivery of contracted items is completed and accepted.
Bids may be rejected if unit prices are unbalanced, if the bidder fails to demonstrate sufficient facilities and experience, or if the bidder is in arrears or default to the city.
