The contract will be a firm-fixed-price contract with specified reimbursable work elements.

The contractor must contact installers or manufacturers, as appropriate, for work that is covered under a warranty and maintain records of warranty service. The contractor must avoid actions that would invalidate a warranty, unless authorized by the COR. If an installer or manufacturer fails to comply with the terms of a warranty, the contractor must immediately notify the COR or designee.

The selection process will be a full and open, competitive source selection. The basis of the award is a tradeoff process decision, indicating the Contracting Officer may award to other than the lowest priced offeror or the highest technically rated offeror.

The contractor must be a registered firm in SAM. gov and meet all requirements set forth in the RFP. Specific qualifications for technicians are detailed, including NICET certification for fire alarm and sprinkler system technicians, and licensed stationary engineers and electricians.

The document mentions potential deductions for nonperformance or unsatisfactory performance and liability for damage caused by contractor negligence.

The document implies that failure to meet contract requirements, including quality control and performance standards, could lead to a performance evaluation that is less than satisfactory, even with corrective actions.

Deliveries are expected within fifteen 15 days of purchase order date. All items are to be off truck, inside delivered.

Payment shall be made within sixty 60 days following the receipt of a correct, original invoice.

Materials, supplies, equipment and services provided pursuant to the bid against defective workmanship for a period of one 1 year and for a period of two 2 years against defective material or in accordance with manufacturer warranty, if longer than two 2 years.

Award will be made as soon as possible after bid opening to the lowest responsible bidder meeting specifications.

Bidders must submit bids in sealed envelopes to the BOCES purchasing office for the furnishing and delivering, and installing where called for, of the materials, supplies and/or equipment, as required by BOCES, and as set forth in the bid documents.

Failure to fulfill any portion of a contract or bid may be cause to remove a successful bidder from receiving any future bids.

It will be presumed that each bidder will have inspected the site and to have examined and to be thoroughly familiar with the drawings, general requirements and specifications including all addenda thereto prior to bid opening.

The board reserves the right to require any bidder to submit a sample before the awarding of the bid to ascertain whether or not the product will be suitable for the purpose for which it is to be used and whether it meets the equivalency of the designated standard.

Requests for clarification or additional information related to this bid must be submitted in writing by mail, fax, or email on or before May 28, 2026.

Vendor changes to bid specs and/or bid form may render a bid nonresponsive and the bidder may be disqualified.

The bid document states that the contractor will be responsible for all required permits and fees. Work will commence within ten 10 calendar days after receipt of written notice to proceed and be substantially completed within 60 calendar days from the receipt of the notice to proceed.

The county of Mercer shall pay the submitted bill not more than 30 calendar days after the receipt of the bill by the owners representative if the contractor has performed in accordance with the contract and the work has been approved and certified by the owners representative. The billing shall be deemed approved and certified 20 calendar days after the owners representative receives it, unless the owners representative provides, before the end of the 20day period, a written statement of the amount withheld and the reason for withholding payment.

All equipment shall be provided with appropriate manufacturer warranties, including a manufacturer warranty of no less than 3 to 5 years for loop amplifiers, a warranty of no less than 1 to 2 years for microphones, loop listeners, cables, and connectors, and a warranty of no less than 7 to 10 years for induction loop circuits.

Contract shall be awarded to the lowest responsible bidder as declared by the county of Mercer.

Bidders and subcontractors shall have experience in similar projects. Bidders shall provide three verifiable references.

Pursuant to N. J. S. A. 40a: ****, liquidated damages may be assessed for the violation of any of the terms of the contract, the failure to perform the contract in accordance with its terms and conditions and/or terms and conditions of N. J. S. A. 40a: 111, et seq.

If so requested, the vendor shall submit a sample of the units or merchandise.

Any prospective bidder who wishes to challenge a bid specification shall file such challenges in writing with the contracting agent no less than three business days prior to the opening of the bids.

Failure to submit any of the required items in the bid document checklist is a mandatory cause for rejection of the bid.
