The bid notice states that 5% of the total price will be retainage, due as part of the final payment. Payments to the trade contractor will be made no later than forty-five (45) days after the authority has approved the application for payment. The authority shall pay interest of one and one-half percent (1. 5%) per month on any undisputed amount not paid to the trade contractor.
A two-year onsite warranty is requested to repair or replace the work and services constituting the project. The trade contractor warrants that the trade contractor work will be of good quality and new, free from defects, and conform to the requirements of the trade contract documents. This warranty extends for a period of two (2) years after final acceptance by the authority.
The RFP is focused on the selection of a proposer that will provide the best value to the authority. Proposals will be scored on a point system: qualifications and experience (300 points), technical approach (300 points), commercial terms (300 points), and interview (100 points). Equitable contracting and hiring is a pass/fail criterion.
Proposer qualifications include significant experience in the design, coordination, supply, installation, and testing of similar projects, in-house capacity to produce necessary documentation, and performance and payment bonding capacity or ability to obtain it. The authority also desires to consider the proposer's commitment to equitable opportunities for minority-owned business enterprises (MBE) and women-owned business enterprises (WBE).
The bid notice mentions that failure to comply with prevailing wage requirements may result in civil or criminal penalties. It also states that if the trade contractor fails to diligently proceed with its trade contractor work during a period of dispute resolution, the authority may procure necessary replacement services or work and backcharge all associated costs to the nonperforming party.
The bid notice does not explicitly mention a mandatory or optional site visit. However, it states that the trade contractor shall verify all existing conditions and measurements at the project site before ordering any materials or doing any work.
The scope of services mentions that the trade contractor will provide testing and commissioning of systems. The trade contract agreement also details that the trade contractor will submit material control samples, which are physical examples that illustrate materials and workmanship.

Proposers who fail any pass/fail criterion may have their proposal rejected. The authority reserves the right to reject any or all proposals, amend the selection process, or waive non-material defects. Failure to comply with prevailing wages may result in civil or criminal penalties.
