Original bid bond and consent of surety certificates are due in the purchasing department before the bid due date and time. If the original bid bond and consent of surety is not received in time for the bid unsealing time, the bid cannot be accepted.

Deliveries for regular non-emergencies to the DPW, 28 Poplar St. , must be available Monday through Friday, 8:00 AM to 2:00 PM. The vendor-provided fuel site for school buses must be available Monday through Friday from 6:30 AM to 5:00 PM, and Saturdays from 7:00 AM until 12:00 PM. The bid notice states, The contract will start upon receipt of a fully executed contract and the term is for one year with the option to renew for two additional one year periods. The completion date is one year from execution date with the option to renew for two additional one year periods at the sole discretion of the city.

The bid notice states, The city shall pay the contractor for services rendered under this contract in accordance with the amounts set forth in the contractors bid price form and pursuant to the provisions contained in the contract. It also mentions, The city may withhold any payment to the contractor hereunder if and for so long as the contractor fails to perform any of its obligations hereunder or otherwise is in default under this contract.

The bidder to whom a contract is awarded guarantees to the city of Gloucester all equipment, materials and/or workmanship for a period of 1 year after final inspection and acceptance and shall replace promptly any defective equipment, material and/or workmanship required without additional cost to the city of Gloucester.

A contract will be awarded to the responsive and responsible bidder submitting the lowest total bid price.

Bidders must be able to deliver as needed to storage tanks at the DPW Highway Division located at 28 Poplar St. and must be available to provide fuel at a site within a three 3 mile radius of the Gloucester Public Schools Bus Terminal located at the Omaly School. The fuel site must be able to accommodate school buses. The contractor covenants that it is qualified to perform the services required by this contract and now is, and shall at all times while this contract is in effect, be duly permitted by law to perform such services, and all personnel engaged in this contract shall be qualified, licensed if necessary, and so permitted to do the work they perform.

The bid notice states, Failure to furnish a msds and/or labels on each container may result in civil or criminal penalties, including debarment and action to prevent the vendor from selling said substances, or mixtures containing said substances within the commonwealth. It also mentions, Any damages or losses incurred will be charged to the original contractor. and If the diesel fuel company is responsible for a spill or accidental release of diesel fuel or any contaminant at our facility, the vendor must clean up pursuant to mgl c. 21e and other relevant regulations and the city of Gloucester cannot be charged for the cleanup.

Any prospective bidder requesting a change in or interpretation of existing specifications of terms and conditions must do so at least 5 days, excluding Saturdays, Sundays and holidays, before the scheduled bid opening date. All questions are to be asked on BidNet Direct.

The city reserves the right to reject any and all bids, or to accept that which is deemed in the best interest of the city of Gloucester. Incomplete bids may be rejected. Conditional bids will not be accepted.
