The ordering period begins at the expiration of the implementation period. The base year ordering period will be in effect for one year. The contractor shall not be required to make any deliveries under this contract after 15 calendar days from the expiration date of the contract.

Contractors will be receiving payments from the PPV programs instead of directly from the government. The contractor shall submit invoices in accordance with the businesstobusiness agreements reached with the PPV programs.

The contractor warrants and implies that the items delivered under this contract are merchantable and fit for use for the particular purpose described in this contract.

One award will be made for line item 1. To be considered for award, offerors must submit a price for the base year and all four one-year options for all line items.

Offerors must submit a letter of commitment from the manufacturer if they are not the manufacturer. Manufacturing facilities must have an acceptable CGMP status with the FDA. Only offers from companies that have an acceptable CGMP status on record with the FDA for the facilities identified by the offeror in section 13. 7 below will be considered for award.

Failure to provide awarded product meeting all solicitation/contract requirements by the ordering period start date may result in contract termination for cause. Willful failure or refusal to furnish the required reports, or falsification thereof, shall constitute sufficient cause for terminating the contract.

Proposals that fail to include a price for the base year and each of the four option years may be rejected. Failure to provide an acceptable subcontracting plan may result in contract termination. Failure or refusal to reach agreement with the PPVs and maintain an agreement with the PPVs throughout the entire contract period shall constitute sufficient cause for terminating the contract.

The offer due date is June 11, 2026, at 2:30 PM CT. Proposals must be submitted via email and confirmation of receipt is recommended.

Payment will be made by EFT. Contractors will receive payments from Prime Vendor contractors, not directly from the government. Invoices are submitted according to business-to-business agreements with Prime Vendors.

The estimated budget for this procurement is $38,500.

Bids are due by June 23, 2026, at 2:00 PM. Milk delivery is scheduled for Tuesdays and Fridays between 7:00 AM and 10:00 AM.

Itemized bills shall be mailed monthly by the succeeding fifth calendar day to the school lunch office. Invoices are to be sent to BOE att: Christopher Molyneux.

The award will be based on best lowest price and lowest overall qualified prices as whole after evaluation of all items. The low bid overall shall be only one consideration.

Bidders shall complete and submit the statement of qualifications and references. The town may make investigations to determine the qualifications of the proposer.

Bidders should submit any samples of reports and documents that are necessary to meet the requirements of this bid request. Samples may be requested subsequent to the bid opening.

Failure to submit a bid or proposal that does not address any changes or addendums may result in disqualification. If milk is found not up to specifications, the board may cancel the contract.
