Contract payments cannot be processed until the contract items have been delivered in a satisfactory condition. Payment will be based on an invoice used in the supplier's normal course of business.

The labor, performance, payment and maintenance bond shall guarantee the maintenance and installation and/or construction of the improvement for one year after final acceptance, as security for the correction of faulty and/or defective work.

An award will be made to the lowest responsible and responsive bidder.

Only qualified bidders who have adequate experience, finances, equipment and personnel will be considered in making awards, based upon qualifying data submitted with the bid proposal.

If the contractor fails to complete the work within the time set forth or any approved extension thereof, the contractor shall pay to the town, as fixed, agreed and liquidated damages, and not as a penalty, for each calendar day's delay, the sum of one thousand dollars ($1,****) per day.

Conditional bid proposals will not be accepted. Any conditions set forth in the bid proposal will be deemed a counteroffer and will render the bid proposal nonresponsive.
