The supplier warrants that all items provided are genuine, new and unused unless otherwise specified. The supplier further warrants that all items used during the performance of work are genuine, original, and new components, or are otherwise suitable for the intended purpose. The supplier shall indemnify Argonne for any financial loss, injury, or property damage resulting from non-genuine, non-original, or unsuitable materials.

Evaluation is based on lowest price, technically acceptable criteria.

Quotes must be submitted on or before Monday, June 29, 2026, 10 AM Central Time. The government will not accept late quotes.

Terms are Net 30 days.

Award will be based on the best value of the government considering pricing, delivery, quality and past performance.

Vendors must provide cage code and lead time on their quote. Vendor must be able to invoice through Wide Area Workflow (WAWF).

The award will be based on best value to the government, considering price and delivery. The government will award a firm fixed price ffp purchase order resulting from this request for quote rfq ****, to the responsible offeror whose offer conforming to the solicitation, will be the best value to the government, considering price and delivery in accordance with iaw the statement of work specifications.

Offerors must be responsible and have an active registration in the System for Award Management (SAM). All invoices received by the city are payable within thirty 30 days from receipt, provided they have first been approved by the city department that is the beneficiary of the contract items, and such department has accepted the contract items. Discounts will be allowed for prompt payments as follows: 10 calendar days, 15 calendar days, 20 calendar days 30 calendar days.

The contractor warrants to the city that all goods/work shall be free from defects in design and faulty or improper materials and/or workmanship, shall be in strict compliance with the terms of this agreement and shall be fit and sufficient for the purpose intended. This warranty shall be effective for a period of not less than one year from the date of acceptance by the city of such goods and/or services as satisfactorily complete, and shall be in addition to all other warranties, express, implied or statutory. The warranty shall survive the termination or expiration of this agreement.

The city reserves the right to award to the lowest responsive, responsible bidder, to award multiple contracts and to award the bid/contract that is deemed, to be in the best value most advantageous to the city as determined by some or all of the following: prices offered, quality of product/service offered, general reputation and performance capabilities of the bidder, conformity with specifications herein, delivery and/or installation schedule, location and availability of service and/or repair facilities, personnel and parts, suitability for intended use, responses to provided references, payment terms/discounts offered, demonstrations provided, if required, ability to meet contract requirements such as warranty provisions, insurance requirements, bonding requirements, etc.

All contractors for these services must have adequate industry and professional qualifications. All contractors must be in business for a minimum of at least three continuous years.

Failure to execute the contract, file acceptable bonds and submit acceptable evidence, if required by contract, of good faith efforts to obtain participation by disadvantaged businesses within 15 calendar days after the contract has been received by the bidder shall be just cause for the cancellation of the award of contract and the forfeiture of the cash or bid bond which shall become the property of the city, not as a penalty, but in liquidation of damages sustained.

Samples of items, when required, shall be furnished free of cost to the city. Samples of items selected may be retained for future comparison.

Any protest concerning the award of this bid shall be addressed to the procurement department director. Protest shall be made in writing to the procurement department director and shall be filed within seven days after the intended award is announced.

Any of the following reasons may be considered as being sufficient for the disqualification of a bidder and the rejection of their bid or bids: More than one bid, for the same work from an individual, partnership or corporation under the same name or a different name; evidence of collusion among bidders; bidder, or its principals or affiliates, is disbarred, suspended, or ineligible from federal contracting.

Proposals must be received by 12:00 PM local time on July 9, 2026. Deliveries are to be made between 7:00 am and 1:00 pm, Monday through Friday, excluding holidays, unless prior approval is given.

The town's policy is to pay all claims in a timely manner within the specified time. If payment is delayed, the town will take the discount when payment is made. The town will not pay any interest charges, nor refund discount amounts taken after the discount period. If this is unsatisfactory, please quote net.

Materials furnished are to be new and unused. All materials furnished or work performed are to be guaranteed free from defects. Anything found defective or not meeting specifications may be rejected and shall be made good by the contractor at his own expense.

The Town will award to the lowest responsible bidder, considering the delivered cost for the product listed per projected quantities and a review of the product specification and SDS sheets.

Respondents must be qualified. Within five days of notification, the lowest three bidders must present information and documentation to satisfy the town that the bidder possesses sufficient capital resources, skill, judgment, and experience to perform the work or deliver the material.

Failure to meet the delivery schedule as per the accepted bid may result in legal action by the Town of Amherst to recover damages.

Questions received within 5 days of the bid opening will not be responded to.

Any change in wording or interlineation by a bidder of the inquiry as published by the Town of Amherst shall be reason to reject the proposal. Failure to provide insurance in acceptable form within 14 days after notice of award may result in the vendor being declared nonresponsive.
