The City of Poughkeepsie is seeking contractors to repair masonry sidewalks and catch basins scattered throughout the city. The initial contract term is for a minimum of one year with the possibility of two one-year extensions. The contractor must provide performance and labor bonds. The contractor is responsible for obtaining all required licenses and permits. The contractor must comply with the New York State Labor Law, including prevailing wage requirements. The contractor must maintain insurance policies with specific limits and include the City of Poughkeepsie as an additional insured. The contractor must maintain the work site in a neat and clean condition. The contractor must provide a schedule of progress within ten days of the contract date. The contractor must comply with section 3 of the Housing and Urban Development Act of 1968. The contractor must be registered with the New York State Department of Labor's Contractor Registry. The contractor must submit certified payrolls through the NYSDOL's certified payroll system. The contractor must maintain records for six years. The contractor must provide a sworn document listing the breach and damages 90 days before commencing suit against the city. The contractor must pay all costs and expenses, including reasonable attorneys fees, in enforcing the terms of the agreement.
The work must be fully and satisfactorily completed by the day of 2027. The contractor agrees to commence performance of the work on or about the day of 2026, commencement date with the work to be fully and satisfactorily completed by the day of 2027.
The owner agrees to pay up to the sum of not to exceed, for the work to be performed in accordance with the terms and conditions of this contract. Pursuant to the contractors bid proposal, the owner agrees to pay up to the sum of not to exceed, for the work to be performed in accordance with the terms and conditions of this contract, and the contractor agrees to accept said sum as full compensation for any and all work performed, unless this contract expressly provides otherwise.
The contractor warrants all materials and work provided under this contract against defects or failure for a period of one year. he contractor warrants and represents that all mechanical and electrical equipment are free from defects of design, materials and workmanship, and further warrants all materials and work provided under this contract against defects or failure for a period of one 1 year from the date of final payment.
The contractor and its officers, employees, agents, servants, consultants, and subcontractors must possess the licenses, experience, knowledge, and character necessary to qualify for the duties. he contractor specifically represents and covenants that the contractor and its officers, employees, agents, servants, consultants, and subcontractors have and shall possess the licenses, experience, knowledge andcharacter necessary to qualify the contractor or its officers, employees, agents, servants, consultants, and subcontractors, individually, for the particular duties to be performed hereunder.
