The county may require up to thirty-one days to process payment after receiving billing in the proper form. it is understood and agreed that the county may require a maximum of thirtyone 31 days to process payment after receiving billing in the proper form.

The contractor warrants that all work, equipment, and materials are free from defects for one year after final acceptance. he contractor warrants and guarantees to the county that all work, equipment, and materials furnished under the agreement are free from defects in workmanship and materials for a period of one year after final acceptance by the county.

Liquidated damages will be assessed for each calendar day the contractor is in default of the completion time. in the event the contractor shall fail to complete all the work to be performed by the completion time aforementioned, the contractor shall pay to the county as and for liquidated damages, not as a penalty, the applicable sum set forth in the schedule below, for each and every calendar day that the contractor shall be in default.

A final inspection is required upon completion of the work. when the work is completed, the contractor shall file a written notice with the project manager that the work, in the opinion of the contractor, has been finished. within ten 10 days after the contractor files the written notice, the project manager and the contractor shall make a final inspection of the project to determine whether all of the work has been completed in accordance with this agreement and with all documents incorporated herein.

If the contractor considers any instructions or decisions unsatisfactory, they must file a written protest within five days. if the contractor considers such instructions or decision to be unsatisfactory, it shall, within five 5 days after their receipt, file a written protest with the adams county purchasing office stating the objections and the reasons therefore.

The announcement is a pre-solicitation synopsis with a posted date of 30 June 2026.

The exposed aggregate finish will be warranted for a minimum of 5 years against delamination, bond failure, excessive discoloration, aggregate loss, and structural cracking attributable to workmanship. Internal components, valves, and controls of the filtration system will carry a minimum 1-year warranty. The filtration tank will have a minimum 10-year structural warranty. A one-year parts and labor warranty is provided for various aspects of the work.

Anticipated award will be given to a responsible bidder whose bid, conforming to the invitation for bids, will be most advantageous to the government, considering only price and the price related factors included in the invitation.

Offerors must be registered in SAM as a requirement for competition.

The bid notice requests delivery within forty-five (45) days of the purchase order.

The bid notice states that payment for the material will be made according to state statute, in the month following the date of delivery, provided a detailed invoice has been furnished by the bidder.

The successful bidder warrants that all geomembranes delivered shall be free from defects in material and workmanship, conform to all applicable specifications, and be fit for the county's intended use. This warranty shall extend for 90 days from the date of delivery of the geomembranes and sandbags. Cowlitz County may also avail itself of the bidder's standard warranty if it is more beneficial.

It is the intention of the county to make award on a total package basis, but Cowlitz County reserves the right to award on an individual item basis or in any manner that is considered to be in its best interest.

To be eligible for award, bidders must indicate in the space provided adjacent to each item whether the material they are offering meets, exceeds, or deviates from the desired technical specifications, with a specification sheet attached.

The county may cancel any purchase order/contract, or any part thereof, by written notice at any time without penalty if the bidder fails to comply with the terms, instructions, specifications, delivery completion date, or to perform the work with diligence.
