Technical evaluation factors include the ability to provide and sell the specified diesel and meet delivery requirements.
Delivery is required within 30 days of award of contract. Window hours for delivery are 8 am to 3 pm Monday through Friday, except federal holidays.
Payment will be made in accordance with the prompt payment act 31 **** and prompt payment regulations at 5 CFR part ****.
The contractor warrants and implies that the items delivered under this contract are merchantable and fit for use for the particular purpose described in this contract.
The government intends to award a low priced, technically acceptable, single award firm fixed-price purchase order. Award will be made without tradeoffs based on lowest price, technically acceptable (LPTA) procedures.
Quoters must have an active registration in the System for Award Management (SAM) in order to provide a quote and be eligible for award. Factor 1: Ability to provide and sell dyed ultra low sulfur diesel. Factor 2: Ability to meet delivery requirements.
The government may terminate this contract, or any part hereof, for cause in the event of any default by the contractor, or if the contractor fails to comply with any contract terms and conditions.
Agency protests may be filed with the contracting officer or at a level above the contracting officer. Protests must be served upon the contract law division of the office of the general counsel within one day of filing.
Failure to provide all information to aid in the evaluation may be considered nonresponsive. Quotes that are nonresponsive may be excluded from further evaluation and rejected without further notification.
