Delivery shall be made within ten 10 days after receipt of order.

Prompt payment discounts allowing less than thirty 30 days for discount to apply shall not be considered as a cost factor in the evaluation of bids. Award will be made to the lowest responsive and responsible bidder whose bid is the lowest best value offer to the city by total bid price unless the city determines that it is in its best interest to award by item or group if doing so results in lower overall costs after factoring in the costs of making multiple awards.

The bidder must present within 48 hours of a request evidence satisfactory to the director of purchasing of performance ability and possession of necessary facilities, pecuniary resources and adequate insurance to comply with the terms of these specifications and contract documents.

At the citys option, upon the contractors failure to furnish items within the time periods stipulated herein, the city may purchase such items on the open market. Any excess costs incurred as a result of such action shall be deducted from monies due to the defaulting vendor.

The city reserves the right to require samples andor sufficient product information to be supplied by a bidder prior to award to determine whether or not the products offered meet the citys requirements.

Bids will not be accepted for products in which specimen labels and material safety data sheets are unavailable. Bids submitted without a complete catalog and price list will be considered incomplete bids and may be rejected. The city reserves the right to reject any bid where prices or discounts offered are unbalanced or otherwise inconsistent with current market prices.

Payment will be made upon receipt and acceptance by the county of completed services, goods and/or products ordered and receipt of a valid invoice, in accordance with the Texas Government Code, Chapter 2251. The county will incur no penalty for late payment if payment is made within thirty 30 or fewer days from the statement if there is an uncontested billing.

The bid award shall be based on, but not necessarily limited to, the following factors: unit price, total bid price, delivery date, results of testing samples, special needs and requirements of Dallas County, Dallas County's experience with products bid, vendors past performance record with Dallas County, Dallas County's evaluation of vendors ability, estimated costs for supplies, maintenance, etc. , estimated surplus value, and small business enterprise completed forms. Dallas County shall award this contract to the responsive bidders offering the lowest and best bid.

In the event the contract is prematurely terminated due to default, nonperformance and/or withdrawal by the contractor, Dallas County reserves the right to seek monetary restitution to include but not limited to withholding of monies owed from the contractor to cover costs for interim services and/or to cover the difference of a higher cost difference between termination vendors rate and new company's rate beginning the date of vendor's termination through the contract expiration date.

After bid opening and before award, county may perform a pre-award survey of the bidders facilities and equipment to be used in the performance of work under this solicitation. Bidder agrees to allow all reasonable requests for inspection of his or her facilities.

Upon request by Dallas County, bidders agree to furnish samples and/or demonstrations of products bid, as applicable. The products requested will be furnished at no additional cost to Dallas County and will be of sufficient amounts and/or time frames agreed by county and bidder to ensure effective testing of the products.

In the best interest of the county, as determined by the Dallas County Commissioners Court, any bidder/proposer who is currently involved, either directly or indirectly, with any litigation against or involving Dallas County may be disqualified and/or not considered for an award.

Sealed bids must be received by the purchasing director by two 2 oclock p. m. local time on June 25, 2026.

The municipalityies will pay the bidder or contractor the amount of his bid upon the full and faithful performance of the contract, acceptance of materials andor work by authorized municipal agent, and upon receipt of the vendor invoices from the receiving department.

Municipalityies requires a oneyear warranty from the date of acceptance to correct at no additional cost to the municipalityies any failure or defect in material and workmanship, which appears in the equipment, goods or services supplied under this bid.

Award will be made to the lowest responsive and responsible bidders for the contract, by any method deemed to be in the best interest of the Syracuse City School District.

Bidders shall submit with their bid the names of at least three 3 public school districts, and their addresses, phone numbers and contact persons where they currently provide similar service as described herein.

Failure to deliver as guaranteed may result in termination of the contract and also disqualify bidder from receiving contracts for at least two years.

Bidders are required to satisfy themselves, by personal examination of the site as to work involved and of the difficulties likely to be encountered in the performance of work under this contract.

Samples are required to be furnished by the bidder at the request of the purchasing director. Samples are to be furnished at no cost to the municipalityies.

Interpretations and questions relating to bid requirements, specifications, drawings, etc. must be submitted in writing to the contact person identified in special conditions not later than 7 calendar days prior to the bid opening.

Bidders are required to submit with their bid the certificate of registration. Failure to submit the certificate of registration may render the bidder nonresponsive and the bid could be disqualified.

The contract resulting from this bid invitation shall commence on the date of award and end on June 30, 2027. The contract may be extended for up to three 3 additional periods of one year or less, upon mutual agreement of the contracting parties.

The contract may be cancelled or annulled by the director of purchasing in whole or in part by written notice of default to the contractor upon nonperformance or violation of contract terms. The city may proceed to meet its requirements by awarding a contract to another bidder, seeking new bids, andor obtaining products/services specified on the open market. In any event, the defaulting contractor or the surety shall be liable to the city for costs to the city in excess of the defaulted contract prices.

The refusal of the vendor, or any of its officers, directors, partners, members or agents, when called before a grand jury, to testify concerning any transaction or contract had with the state of New York, any political subdivision thereof, a public authority or with any public department, agency or official of the state of New York or of any political subdivision thereof or of a public authority, to sign a waiver of immunity against subsequent criminal prosecution or to answer any relevant questions concerning such transaction or contract, shall disqualify the vendor and such officer, director, member or agent thereof from thereafter selling to or submitting bids to or receiving awards from or entering into any contracts with any municipal corporation in the state of New York or any public department, agency or official thereof, for goods, works or services, for a period of five 5 years after such refusal and any or all contracts made with any municipal corporation or a public department, agency or official thereof, by such person, and by any firm, partnership or corporation of which he is a member, partner, director or officer, may be cancelled or terminated by the municipal corporation without any liability on the part of the municipal corporation or any penalty or damages on account of such cancellation or termination.
