Sealed proposals are invited for the redevelopment of wells at the John S. Roth Wellfield. Bids are due by Tuesday, July 21, 2026, at 11:00 AM. Bid documents can be obtained from the Purchasing Office or downloaded from www. ***. *. * should be directed in writing to the purchasing department. Bids will be opened via Webex. A bid bond of 10% of the total bid amount is required. Performance and labor and material payment bonds of 100% of the contract sum are required after award. A maintenance bond of 10% of the contract sum is required after completion. The contract term is 12 months, with an option to renew for one additional year. The city reserves the right to reject any or all bids.
Bids must be received by Tuesday, July 21, 2026, at 11:00 AM. The bidder shall commence work within ten 10 consecutive calendar days from the date specified in the notice to proceed and shall agree to fully complete the work in accordance with the time frame specified. it is the responsibility of the bidder to plan accordingly that bids are received by the set date and time.
Progress payments shall be made in accordance with item 1. 9. 2, page 67 of the general conditions of the contract. At least ten 10 days before each progress payment falls due but not more than once a month, the contractor will submit to the engineer, for review, an application for payment. The amount paid to the contractor shall be the amount due less five percent 5 retainage. The retainage will be held by the owner until the completion of the work.
A maintenance bond in the amount of ten percent 10 of the contract sum shall be required after completion of work and prior to final payment. The principal agrees to maintain the work completed in the contract, stated above, for a period of twelve 12 months from the date of final payment and issuance of a certificate of completion, without additional cost to the city.
The contract will be awarded to the lowest responsible bidder, determined by factors including skill, ability, integrity, professional references, reputation, and the best interests of the city. he contract will be awarded by the owner to the lowest responsible bidder, as determined under the factors to be considered under section ****, as amended, of the middletown code of ordinances.
The city may make investigations to determine the bidder's ability to discharge their contract. The bidder must furnish all necessary information and data. The city reserves the right to reject any proposal if the bidder fails to satisfactorily convince the city of their qualifications. The bidder shall furnish the city with all such information and data as may be required for that purpose.
Failure to commence work within ten 10 days of the notice to proceed or failure to execute the contract within ten 10 days of award may constitute a breach of contract, leading to cancellation of the award, re-bidding, and potential damages. Liquidated damages of **** per calendar day for incomplete work are specified. Failure or neglect to do so shall constitute a breach of contract for which the city may cancel the notice of award, award the bid to someone else, or rebid the entire project as well as sue for damages.
