The contractor warrants and implies that the items delivered hereunder are merchantable and fit for use for the particular purpose described in this contract.
The government will award a contract to the responsible offeror whose proposal, conforming to the solicitation, will be most advantageous to the government, price and other factors considered. Technical capabilities, business operations, past performance, SDVOSB/VOSB evaluation, small business participation plan, and price are used for evaluation.
Contract physicians must have a current, full, and unrestricted license to practice medicine in any state, territory, or commonwealth of the United States or the District of Columbia. All physicians must be board certified or board eligible in diagnostic radiology and/or nuclear medicine. They must also be technically proficient and fluent in English.
Failure to comply with contract terms, including data security and privacy provisions, may result in liquidated damages for data breaches (**** per day per affected individual), suspension or termination of access privileges, and contract termination for default or cause.
Protests must be filed directly with the agency or the Government Accountability Office (GAO) and served on the contracting officer within one day of filing with GAO.
