The contractor must begin work at each patch location within three business days after notification and provide continuous labor and materials to complete all work at each patch location. For high traffic roads or high priority areas, restoration may need to occur within 24 hours of notification.

The City of Rockford intends to comply with the Local Government Prompt Payment Act. Awarded vendors will be paid upon submission of invoices to City of Rockford Accounts Payable. Monthly invoices are required, detailing each patch location, the city division, pay item, size, tonnage, and amount for current payment.

Any roadway with seams that fail within the first two years after construction shall be milled and resurfaced to full width at the contractor's own expense and to the satisfaction of the owner.

The contract will be awarded to the lowest responsible and responsive bidder. The city may choose to award on a per-item basis or a lump sum basis.

Each proposal shall include a statement of qualifications demonstrating the bidder's experience and ability to successfully perform the work. At a minimum, the bidder must have completed at least three projects of similar scope within the past five years.

Liquidated damages will be assessed on a daily basis for failure to complete work on time. Failure to comply with contract terms may result in the city barring the vendor from bidding for a period of up to three years.

Firms wishing to protest bids or awards shall notify the Central Services Manager in writing within seven days after the invitation to bid opening.

The sealed proposals and electronic submittals shall be received until April 15, 2026, prior to 3:00 p. m. Please allow time to upload required documentation; 24 hours in advance is recommended.

The contractor shall receive compensation for services provided on a monthly basis. Upon the end of each month, during the contract period, the contractor shall submit an invoice to the business development director for the monthly cost of maintenance. Any extra work shall be shown on the same monthly invoice and identified as extra work.

Selection shall be based on the responsible offerors whose proposal is determined to be the most advantageous to the City of Lubbock considering the relative importance of evaluation factors included in this RFP. The following criteria will be used to evaluate and rank submittals: Price (30 points), Qualifications/Experience (50 points), and Project Approach (20 points).

Offerors are required to describe a minimum of three most recent projects and provide references. The proposal should also include a description of the methodology to be used, identification of assigned positions and their roles, suggested project schedule, specific expertise, a brochure of past work, a list of principals and other professionals to be used, and the organizational structure of employees assigned to the project.

If the contractor fails to remove material within 48 hours after written notification from the agent, the city shall remove the material and charge the contractor for the expense, which will be deducted from the contractor's payment. If such conditions continue, the contract may be terminated due to breach of contract. Any penalties, fines, or citations for watering ordinance violations shall be paid by the contractor.

A pre-proposal meeting will be held on April 1, 2026, at 10:00 a. m. via teleconference. While the meeting is not mandatory, it is the proposer's responsibility to attend.

All protests regarding the RFP process must be submitted in writing to the City Director of Purchasing and Contract Management within 5 working days after the protesting party knows of the occurrence of the action which is protested.
