Failure of the contractor to deliver within the time specified, or within reasonable time as interpreted by the director of purchasing, or failure to make replacements of rejected articles when so requested, immediately or as directed by the director of purchasing, shall constitute authority for the director of purchasing to purchase in the open market comparable products or services rejected or not delivered. On all such purchases, the contractor shall reimburse the city within a reasonable time specified by the director of purchasing, for any expense incurred in excess of contract prices or the city shall have the right to deduct such amount from monies owed the nonperforming contractor.
The RPD reserves the right to have agency representatives examine each dog to ensure the canine meets its standards and requirements.
