Failure to be familiar with the Orangeburg County Procurement Code or claiming exceptions not listed may result in disqualification. failure to be familiar with the code does not absolve the submittal entity from compliance with the code. and will disqualify that entity if found in violation of the code.

Proposals must be submitted by June 30, 2026, at 2:00 PM local time.

Payment shall be made monthly, upon pre-agreed milestones, or at the end of each project, within 30 days following the submittal of a correct invoice for goods received or work performed.

Contractor shall remove and replace at no additional cost to the city any defects in workmanship or materials that may be apparent or may develop within a period of one 1 year from the date of final acceptance.

Proposals will be evaluated based on firm qualifications, personnel qualifications, work plan, and price.

Firms must be qualified and demonstrate necessary certifications and capacity to perform services in accordance with federal, state, and local regulations. Experience with similar environmental assessment work and grant programs is considered.

Breach of contract may result in cancellation, reservation of rights to damages, and recovery of excess costs.

Protests about the bid procedure must be received by the City of Battle Creek no later than ten (10) working days after notification regarding contract award decision.

Failure to adequately address issues of concern after written notice may result in contract cancellation. Violation of Chapter 214 (discrimination prohibited) is a material breach.

A preproposal meeting will be held on June 9, 2026, at 9:00 am CT, via Microsoft Teams. Proposers are strongly encouraged to attend.

Bids must be received on or before July 13, 2026, at 2:00 PM local time.

Payment will be made in accordance with the Florida Prompt Payment Act, Section ****, Florida Statutes, upon presentation of a proper invoice. The city prefers payment via wire transfer, ACH direct deposit, or an appropriate electronic payment method.

The awarded bidder shall warrant its products and/or service against faulty labor and/or defective material for a minimum period of one year from the date of acceptance.

The city will award this contract to the responsive and responsible bidder who submits the lowest price to perform the work.

Bidders must be registered with the state of Florida, have been in business for a minimum of five years, and have a minimum of three years of wet lime sludge hauling/disposal operations within the state of Florida.

The city reserves the authority to cancel the contract and secure services from another vendor if the awarded bidder fails to deliver or complete the work within the time stated in the contract. The city may demand payment for any additional costs incurred.

It is recommended that the bidder visit the site of the proposed work and become familiar with any conditions that may affect the work.

Vendors may be deemed non-responsible if they have been declared in default on any city or public entity contract, debarred, or suspended by any public entity.
