The successful bidder will have 5 business days to pay for and remove the tractor equipment.

Payment can be made by verified check, certified check or cash.

The tractor equipment is being sold as is, where is without any warranty expressed or implied.

Bids should include the date, bid amount, signature, and telephone number of the person bidding.

For inquiries or to view the equipment, please call the animal shelter at 256 ****, or the Etowah County Commission at 256 ****.

The Etowah County Commission reserves the right to reject any and all bids.

Material shall be delivered the next business day from the time of notification, with 25 c. y. end dump trucks with a minimum material capacity of 20 c. y. In case of an emergency, delivery will be within 4 hours.

Payment will be made on a monthly basis after satisfactory completion and inspection of the work by Brownsville Pub personnel. Submit invoices to Brownsville Public Utilities Board, attn: Purchasing Department/Warehouse, Diane Solitaire, **** FM 511, Olmito, Texas ****.

The bidder shall warranty and guarantee the work, equipment and materials for a period of at least one 1 year after date of final acceptance in writing by the owner.

Determining factors for award include: Compliance with requirements of the technical specifications, Net price, Reputation of bidder, Evidence of completion of similar work, Time and conditions of delivery, and Safety record.

The owner reserves the right to consider as not responsible, any bidder who does not habitually perform with his own forces the major portions of the work involved in construction of the improvements embraced in this proposed contract. This shall also apply to any proposed subcontractors.

If the bidder fails to execute the contract and to furnish satisfactory performance and payment bonds and insurance certificates within ten 10 days from the date on which he is notified that his bid has been accepted, the amount of his check or bid bond shall be forfeited to the brownsville pub as mutually agreed to liquidated damages, and not as a penalty.

Each bidder shall visit the sites of the proposed work and fully acquaint themselves with the existing conditions there relating to services and labor. Visits to the sites shall be arranged by calling Marisela Gaytan at telephone no. 956 ****.

Failure to sign bid will disqualify it. Failure to submit bid security will disqualify bid. Failure to submit any of the required information with the sealed bid will disqualify bid.

Preferred delivery date is 120 days after order.

The period of performance for this contract is from 07/01/2026 to 06/30/2027.

Payment will be made by electronic funds transfer through the Department of Treasury's Invoice Processing Platform (IPP) at www. ***. *. * invoices complying to the requirements at **** g must be submitted through www. ***. *. *

The government will award a contract to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the government, price and other factors considered. The factors are: 1. Price 2. Technical capability to meet the governments needs in accordance with the statement of work project description 3. Timetable and workplan.

The vendor must have certifications to create a SWPPP. The contractor shall perform work in accordance with best common practices and standards, including safety and hazard awareness, NFPA criteria, EPA cleanup standards, and requires a Professional Engineer to sign off on the SWPPP.

Contractors perform at their own risk when accepting direction from unauthorized officials. The government is not liable to the contractor or under the terms of the contract, financially or otherwise unless the unauthorized commitment successfully passes the ratification process.
