HHS system agency will make contract payments in accordance with chapter **** of the Texas Government Code, commonly known as the Texas Prompt Payment Act.

The contractor shall guarantee all work included in the purchase order against defects in workmanship and shall satisfactorily correct, at no cost to facility, any such defects that become apparent within a period of one year after completion of work.

The bidder shall have relevant experience required for the performance of the services as outlined in this IFB. The minimum experience required is five 5 years. The bidders personnel to be assigned to perform the services must be fully trained and, at minimum, have three 3 years relevant experience.

An optional on-site visit will be conducted on June 9, 2026, 10:00 am CT at Lubbock State Supported Living Center, **** North University Lubbock, TX ****.

Delivery of items for city inventory must be made within ten 10 calendar days after receipt of purchase orders. Hot water heaters must be available the same day as the order is placed.

Prompt payment discounts allowing less than thirty 30 days for discount to apply shall not be considered as a cost factor in the evaluation of bids. Time for discount will be computed from the date of receipt of correct invoice or receipt and acceptance of shipment, whichever is later.

The contractor shall unconditionally guarantee the materials and workmanship of all products furnished and/or services provided for a period of at least one 1 year from date of acceptance.

The city intends to award a contract to the responsive and responsible bidder whose bid is the lowest best value offer to the city on the basis of the total group price or grand total bid price.

The city may consider whether the bidder has adequate facilities, employs qualified personnel, has sufficient inventory, is open for business during specified hours, and has previous performance under comparable contracts.

Failure of the contractor to deliver within the time stipulated or to make replacements of rejected articles when requested shall constitute authority for the city to purchase in the open market and the contractor shall reimburse the city for any excess expense incurred.

Samples submitted by bidders on items which they have received an award may be retained by the city until the delivery of contracted items is completed and accepted.

Bids may be rejected if unit prices are unbalanced, if the bidder fails to demonstrate sufficient facilities and experience, or if the bidder is in arrears or default to the city.

All work must be completed by August 31, 2026.

Payment will be made in accordance with the pricing provided on exhibit C pricing sheet. Invoices must be submitted monthly or as otherwise indicated on the purchase order.

The award will be made to the bidder whose response offers the best value to the state based on all factors considered, including price, meeting or exceeding requirements, and ability to meet performance delivery requirements.

The contractor shall provide samples of laminate for countertops, cabinets, cabinet hardware, sink, and touchless paper towel dispenser for agency approval. Three paint samples for walls and door trim are also required.

Failure to attend the mandatory site visit, not being listed on the attendance log, submitting exceptions to the IFB, including assumptions in the response, or failing to comply with communication restrictions may result in disqualification.
