The successful proposer agrees to deliver to the designated locations on or before the date as specified in the finalized contract. Failure to deliver on or before the specified date constitutes an event of default by the successful proposer.
CMHA will not pay invoices until services are fully completed as scheduled and/or products are received. CMHA will pay properly submitted invoices in approximately 30 days. Payment shall be contingent upon review and acceptance of the contractor's deliverables by CMHA.
The services provided under the contract shall conform to all information contained within the RFP documents as well as applicable industry published technical specifications. Contractor will respond within an 8-hour period to call backs for warranty work as deemed by CMHA.
The authority shall award a contract only to a responsible prospective contractor who is able to perform successfully under the terms and conditions of the proposed contract. The authority will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the authority, cost or price and other factors, specified elsewhere in this solicitation, considered.
All proposers will be required to submit adequate information showing that the proposer is qualified to perform the required work, i. e. , profile of firm form and required resumes. To be determined responsible, a prospective contractor must have adequate financial resources to perform the contract, or the ability to obtain them, have a satisfactory performance record, have a satisfactory record of integrity and business ethics, have a satisfactory record of compliance with public policy, and not have been suspended, debarred, or otherwise determined to be ineligible for award of contracts.
CMHA may, in its sole discretion, withhold payments claimed by contractor for services rendered if contractor fails to satisfactorily comply with any term or condition of this contract. Payments may also be reduced for performance standard deductions. Failure to provide invoices may result in withholding of payment for such parts.
A preproposal conference or walkthrough may be scheduled. Pursuant to HUD regulations, the preproposal conference or walkthrough is not mandatory, but is recommended.
If requested by the authority, it shall be the responsibility of the proposers to furnish the authority with sufficient data or physical samples, within a specified time, so that the authority may determine if the goods or services offered conform to the specifications.
The alleged aggrieved protestor must file, in writing, to the PO the exact reason for the protest, attaching any supportive data. The protestor must state within the written protest document specifically not by inference what action by the authority or condition is being protested as inequitable, making, where appropriate specific reference to the RFP documents issued. The protest document must also state the corrective action requested. The written instrument containing the reason for the protest must be received by the PO within 10 days after the occurrence of any of the following: the deadline for receiving proposals, receipt of notification of the results of the evaluation or the award, or the alleged aggrieved protestor knows or should have known the facts.
